BROWARD CULTURAL DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTION.
This item supports the Board's value of "Cultivating community culture, arts, recreation and life-long learning" and goals to provide diverse artistic, cultural, educational, and historical amenities and programs that contribute to a vibrant, multi-cultural, and economically-viable community.
Broward County's Cultural Division ("Division") requests the Board to approve a new standard form agreement for Cultural Incentive Programs for use in substantially this form for the current Fiscal Year and for up to four additional Fiscal Years, subject to any legal updates as may be required from time to time and approved by the Office of the County Attorney, and any nonsubstantive changes approved by the Division's Director after approval as to legal sufficiency by the Office of the County Attorney.
For the following Cultural Incentive Programs, the Board approves the grant award amount for each of the recipients (grantees):
- Cultural Investment Program;
- Cultural Tourism Program;
- Cultural Institution Program;
- Regional Investment Program;
- Cultural Diversity Program;
- Community Arts Education Partnerships;
- Cultural Planning and Facilities Program; and
- Tourist Development Tax Capital Challenge Grant Program.
For the following three Cultural Incentive Programs, the Broward Cultural Council approves the grant award amount for each of the recipients (grantees), subject to the total budgeted amount approved by the Board for the applicable incentive program:
- Creative Investment Program;
- Creative Place Making Program; and
- Cultural Festival Program;
The use of the standard form agreement is consistent with the authority provided in Sections 29.17, 33.30 and 33.31 of the Broward County Administrative Code. Any agreement that deviates materially from the approved standard form agreement will be presented to the Board for approval and execution unless the modification is required for compliance with applicable law, permitted under the Broward County Administrative Code, required by the County's Risk Management Division as to insurance requirements, or required by the County Auditor's Office as to audit requirements.
The new standard form agreement will not change the eligibility or funding requirements for the incentive programs. Eligibility for the programs is governed by the Broward County Administrative Code. This item does not approve funding for any grant. |
