AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO CHILD CARE FACILITIES AND FAMILY CHILD CARE HOMES; AMENDING VARIOUS SECTIONS OF CHAPTERS 7 AND 20 OF THE BROWARD COUNTY CODE OF ORDINANCES ("CODE") RELATING TO THE REORGANIZATION OF THE CHILD CARE LICENSING AND ENFORCEMENT SECTION ("CCLE") AND RELOCATION OF CCLE FROM THE COMMUNITY PARTNERSHIPS DIVISION, HUMAN SERVICES DEPARTMENT, TO THE ENVIRONMENTAL AND CONSUMER PROTECTION DIVISION, ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT; EXPRESSLY AUTHORIZING CCLE TO ENTER INTO SETTLEMENT AGREEMENTS AND TO ESTABLISH RELATED POLICIES; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

B. MOTION TO CONSIDER adoption of a Resolution No. 2019-040 Amending the Broward County Administrative Code, the title of which is as follows:
 
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA,  PERTAINING TO CHILD CARE FACILITIES AND FAMILY CHILD CARE HOMES; AMENDING CHAPTERS 4 AND 8 OF THE BROWARD COUNTY ADMINISTRATIVE CODE ("ADMINISTRATIVE CODE"),  PROVIDING  FOR  CHANGES  TO ORGANIZATION AND FEES; RELOCATING THE CHILD CARE LICENSING AND ENFORCEMENT SECTION FROM THE COMMUNITY PARTNERSHIPS DIVISION, HUMAN SERVICES DEPARTMENT, TO THE ENVIRONMENTAL AND CONSUMER PROTECTION DIVISION, ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT; REPEALING PART II OF CHAPTER 36 OF THE ADMINISTRATIVE CODE; CREATING SECTION 40.51 RELATING TO CHILD CARE FACILITY AND FAMILY CHILD CARE HOME LICENSE AND REGISTRATION FEES; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE ADMINISTRATIVE CODE, AND AN EFFECTIVE DATE.

Why Action is Necessary
A. A Resolution directing the County Administrator to publish notice of public hearing to consider enactment of the Ordinance was adopted by the Board of County Commissioners at its meeting of January 8, 2019.

B. A Resolution directing the County Administrator to publish notice of public hearing to consider adoption of the Resolution Amending the Broward County Administrative Code was adopted by the Board of County Commissioners at its meeting of January 8, 2019.
What Action Accomplishes
A. Provides for amendments to the Code of Ordinances relating to the reorganization of the Child Care Licensing and Enforcement Section.

B. Provides for amendments to the Broward County Administrative Code relating to Child Care Facilities and Family Child Care Homes, which amendments are required to ensure consistency with the proposed Ordinance.

Summary Explanation/Background
The proposed Ordinance amends Chapters 7 and 20 of the Broward County Code of Ordinances to (i) implement changes related to the relocation of the Child Care Licensing and Enforcement Section ("CCLE") from the Community Partnerships Division, Human Services Department, to the Environmental and Consumer Protection Division, Environmental Protection and Growth Management Department; (ii) incorporate updated references to the food, nutrition, and food preparation provisions of the relevant State of Florida Department of Children and Families Handbooks applicable to child care facilities and family child care homes, and eliminate certain food preparation and nutrition requirements that are outdated or duplicative of requirements that are incorporated by reference through the applicable Handbooks; (iii) expressly authorize CCLE to enter into settlement agreements and to establish related policies; and (iv) provide for housekeeping changes.
 
The proposed Administrative Code Resolution implements changes related to (i) the elimination of stand-alone food inspection fees for child care facilities and family child care homes and (ii) a revised fee structure for licensing and registration of child care facilities and family child care homes, including the introduction of a license fee reduction for accredited Gold Seal Quality Care child care facilities and family child care homes.
