MOTION TO CONSIDER enactment of an Ordinance, the title of which is as follows:
 
AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO CONSUMER PROTECTION; CREATING SECTION 20-126 OF THE BROWARD COUNTY CODE OF ORDINANCES ("CODE"); PROVIDING FOR EXEMPTIONS FROM CURRENT REQUIREMENTS FOR CERTAIN TRANSACTIONS BY SECONDHAND DEALERS; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

Why Action is Necessary
A Resolution directing the County Administrator to publish notice of public hearing to consider enactment of the Ordinance was adopted by the Board of County Commissioners at its meeting of January 8, 2019.
What Action Accomplishes
Amends the Broward County Code of Ordinances ("Code") to allow for exemptions from current requirements for certain transactions by secondhand dealers.

Summary Explanation/Background
The "Secondhand Dealers" Ordinance, Section 20-123, et seq., of the Broward County Code of Ordinances ("Code"), requires all secondhand dealers to follow more stringent requirements than the state statute for holding secondhand goods and recording transactions. The additional holding and reporting requirements for secondhand dealers under the Code currently apply to several categories of low-risk secondhand sales.
 
The proposed amendment exempts low-risk secondhand sales from the Ordinance requirements consistent with the Board's objectives in regulating secondhand dealers.
