MOTION TO AWARD open-end contract to single bidder, EMSL Analytical, Inc., for Industrial Hygiene Laboratory Services, Bid No. GEN2116890B1, for the Risk Management Division, in the annual estimated amount of $110,245, and authorize the Director of Purchasing to renew the contract for two one-year periods, for a three-year potential estimated amount of $330,735. The initial contract period shall begin on the date of award and will terminate one year from that date.

In accordance with the Broward County Procurement Code, Section 21.14.d.4, Authority of the Director of Purchasing, Board approval is required for any bid award that involves a single bidder, regardless of monetary value.

Provides for Industrial Hygiene Laboratory Services for the Risk Management Division.

THE PURCHASING DIVISION AND THE FINANCE AND ADMINISTRATIVE SERVICES DEPARTMENT/RISK MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

The Office of Economic and Small Business Development did not assign Small Business Enterprise (SBE) or County Business Enterprise (CBE) goals for this project, because there were no subcontracting opportunities for SBE or CBE contractors (Exhibit 2).

The purpose of this contract is to provide Industrial Hygiene Laboratory Services throughout the year by the Risk Management Division.

The Risk Management Division has reviewed the single bid submitted by EMSL Analytical, Inc. and concurs with the recommendation for award (Exhibit 3). One vendor performance evaluation was completed for EMSL Analytical, Inc.; the firm has a rating of 5.00 out of a possible 5.0. Copy of the vendor performance evaluation is available upon request.

The Purchasing Agent researched the prices submitted by the single bidder, EMSL Analytical, Inc., and has determined that the prices submitted are fair and reasonable in comparison to the previous Broward County Contract and the independent cost estimate (Exhibit 4).

Incumbent:
EMSL Analytical, Inc., (Contract No.: G1383107B1, Contract Title: Industrial Hygiene Laboratory Services). Awarded by the Director of Purchasing. Contract Term: November 6, 2015 to November 5, 2018. A 90-day extension was approved by the Director of Purchasing, which extended the contract term until February 5, 2019. Expenditures to date: $151,179.37. The bid was advertised on July 26, 2018 and opened on September 5, 2018; one bid was received with zero declinations (Exhibit 1). The bid opening date was originally scheduled for August 10, 2018. In an effort to conduct outreach to potential bidders, the bid opening date was extended three times to September 5, 2018 to allow for vendor outreach; however, the solicitation resulted in the receipt of a single bid submittal by EMSL Analytical, Inc. It has historically been a challenge for obtaining multiple bidders for the services needed for this procurement. EMSL Analytical, Inc., offered a voluntary price reduction (Exhibit 5).

There was no protest filed regarding this procurement.
