MOTION TO APPROVE Work Authorization No. KA 17-11 in accordance with the Agreement between Broward County and Keith and Associates, Inc. for Continuing Engineering Services for Water Distribution, Wastewater Collection, and Storm Water Collection, Request for Proposal No. R1404111P1, to provide design, permitting, and engineering services during construction for a new sanitary sewer collection system for District 3A Septic Tank Elimination Program Area 3A-N, for a lump sum amount of $141,183, a not-to-exceed salary amount of $120,305, and $27,264 for reimbursable expenses, for a total amount of $288,752, with a time for performance of 686 calendar days, and authorize the Mayor and Clerk to execute same. (Commission District 7)

Why Action is Necessary
Board of County Commissioners' approval is required for Work Authorizations for consultant services when the amount of the services is more than the award authority of the Director of Purchasing, in accordance with Article 4.1.1.2 of the Agreement.

Summary Explanation/Background
THE PUBLIC WORKS DEPARTMENT/WATER AND WASTEWATER SERVICES RECOMMENDS APPROVAL OF THE ABOVE MOTION.

The Office of Economic and Small Business Enterprises established County Business Enterprise (CBE) cumulative participation goal for Agreement R1404111P1 of 25%. Keith and Associates, Inc. committed to a 26% CBE cumulative participation. Professional services under this Agreement are performed through the issuance of Work Authorizations and CBE participation goals apply to the cumulative total value of the Agreement. Keith and Associates, Inc. has identified 13% CBE participation for Work Authorization No. KA 17-11. As of November 2018, Keith and Associates, Inc. has been paid $94,420 with $23,422 paid to CBE firms, yielding 25% participation.

On March 28, 2017 (Item No.35), the Board of County Commissioners approved an Agreement between Broward County and Keith and Associates, Inc. for Continuing Engineering Services for Water Distribution, Wastewater Collection, and Storm Water Collection for Water and Wastewater Services, Request for Proposal No. R1404111P1, to provide engineering services associated with water distribution, wastewater collection, and storm water collection, in a not-to-exceed amount of $1,000,000 per year for the initial three-year term from the date of the executed Agreement, with two one-year extensions which may be executed under the authority of the Director of Purchasing. As of November 2018, seven Work Authorizations have been approved for a current Agreement value of $382,634.

The proposed Work Authorization No. KA 17-11 provides for design, permitting and engineering services during construction for a new sanitary sewer collection system in District 3A Septic Tank Elimination Program Area 3A-N for a lump sum amount of $141,183, a not-to-exceed salary amount of $120,305, and $27,264 for reimbursable expenses, for a total Work Authorization amount of $288,752.

This Work Authorization was negotiated in Sunshine meetings held on May 4, 2018 and September 25, 2018 and was reviewed and approved as to form by the Office of the County Attorney and Risk Management Division.
