THE FINANCE AND ADMINISTRATIVE SERVICES DEPARTMENT/ENTERPRISE TECHNOLOGY SERVICES DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.
Motion A - The Federal Bureau of Investigation (FBI) mandates certain security restrictions on all Criminal Justice Information Systems (CJIS) and access to criminal justice information. The Florida Department of Law Enforcement (FDLE) routinely reviews compliance by criminal justice agencies with the CJIS requirements.
In connection with the regional emergency communications system, the County has current Management Control Agreements with a number of municipalities, as well as with the Broward Sheriff’s Office. County contractors with access to CJIS networks are generally required to execute security addendums. In some instances, the County may need to enter into multi-party agreements with contractors and the applicable criminal justice agencies in order to establish a contractual commitment from the County contractor to the criminal justice agency to comply with CJIS requirements. This item, if approved, would enable the County Administrator to negotiate and execute, subject to review as to legal sufficiency by the County Attorney’s Office, any required agreements to comply with CJIS and FLDE requirements.
Motion B - This motion authorizes the County Administrator to approve and execute information technology agreements that have no out-of-pocket cost to the County for performance of the agreement, but may be required in a variety of instances, such as to enable the County to access state databases, to share data with municipalities or other government entities, or to impose information security requirements on constitutional officers or other agencies that utilize computer networks provided by Broward County or connected to the Broward County computer network.
For example, Broward County provides computer network access and services for the State Attorney’s Office, the Public Defender, the Judicial Information Systems of the Seventeenth Judicial Circuit Court, and the Clerk of Court. Currently, these non-County offices utilize the County’s internet protocol address (IP address) for internet access, which raises security concerns and potentially exposes the County’s network credentials to negative repercussions arising from any weaknesses in the internal computer controls by non-County offices. In some instances, Enterprise Technology Services may recommend establishing separate IP addresses for these non-County offices and/or entering into agreements with these non-County offices to establish basic security requirements. This item, if approved, would authorize the County Administrator to negotiate and execute, subject to review as to legal sufficiency by the County Attorney’s Office, appropriate agreements with these non-County offices to ensure the continued integrity of the County computer network.
This motion would require the agreements to be reviewed and approved by Enterprise Technology Services as to the technology and security aspects of the agreement, and by the Office of the County Attorney as to legal sufficiency. This motion is limited to agreements that have no out-of-pocket financial obligation on Broward County if the agreement is performed in accordance with its terms; this motion would permit approval and execution of agreements that contain indemnification obligations or liquidated damages in the event of a breach of the agreement or other culpable conduct. |
