MOTION TO APPROVE Agreement between Broward County and Leo A. Daly Company for Request for Proposals (RFP) No. S2115731P1, Broward County’s Medical Examiner's Office and Broward Sheriff’s Office Crime Laboratory Combined Facility (deliberately-phased agreement) in the amount of $652,361, including reimbursables in the amount of $5,000, and optional services in the amount of $50,000 and authorize the Mayor and Clerk to execute same.

Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.31.a.4, Board approval is required for awards exceeding $500,000.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/CONSTRUCTION MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.
 
This item supports the Board's Value of "encouraging investments in renewable energy, sustainable practices and environmental protection", with the Goal to "proactively lead in the planning, design and construction of projects supporting resilience and climate adaptation, including coordination with other entities to foster resilient design as part of local and regional projects, especially shore protection efforts".

The Office of Economic and Small Business Development established a County Business Enterprise (CBE) participation goal of 25% for this project. Leo A. Daly Company has committed to meet the CBE participation goal (Exhibit 3).

The Agreement engages Leo A. Daly Company to provide comprehensive architectural and engineering services for the Broward County's Medical Examiner's Office and Broward Sheriff's Office Crime Laboratory combined facility. This is a deliberately-phased agreement that is divided into pre-design and design services.  The  design services will be negotiated toward the completion of the predesign, programming, and public outreach effort. As part of the  programming services, Leo A. Daly Company will complete a needs assessment and site analysis.

The project is intended to be constructed on a vacant parcel of approximately seven acres located in the City of Fort Lauderdale, Florida. The building area is expected to be approximately 135,000 square feet, plus ancillary areas such as parking, mechanical plants, and on-site generators. The new combined facility is anticipated to be organized as a multi-story building or series of buildings with operational and functional synergies. The new building(s) are to be designed as “essential facilities” in order to maintain operations immediately following a disaster or weather event. This includes building height, enhanced ballistic protection for glazing, highest durability building structure and generator operations of critical building systems.

On December 12, 2017 (Item No. 76), the Board approved Request for Proposals (RFP) No. S2115731P1, Consultant Services for Broward County’s Medical Examiner's and Broward Sheriff’s Office Crime Laboratory Combined Facility. The RFP was advertised and, at the time of the opening deadline of 5:00 p.m. on February 23, 2018, six firms submitted proposals.

On April 20, 2018, an Initial Evaluation Committee meeting was held. The Evaluation Committee determined that all six firms were both responsive and responsible to the RFP requirements and would proceed to final evaluation.

On May 7, 2018, a Final Evaluation Committee meeting was held. After presentations, evaluation, scoring and ranking, the Evaluation Committee named Leo A. Daly Company as the first-ranked firm.

The Evaluation Committee's proposed recommendation of ranking was posted on the Purchasing Division website from May 9, 2018 through May 11, 2018, which provided an opportunity for any proposer or interested party to present any new or additional information regarding the responsibility of the proposers. An objection was received from Saltz Michelson Architects, Inc. through its representative, Becker & Poliakoff.  On July 18, 2018, the Director of Purchasing issued a response to Becker & Poliakoff's Objection Letter. This information was provided to the Board at its meeting on August 14, 2018 (Item No. 19). On August 14, 2018, the Board approved the Evaluation Committee’s recommendation of the final ranking of qualified firms, which listed Leo A. Daly Company as the number one ranked firm.

The Evaluation Committee's final recommendation of ranking was posted on the Purchasing Division website from July 26, 2018 through August 1, 2018, which provided an opportunity for any aggrieved proposer to file a formal protest. There was no protest filed within this timeframe.

Four negotiation meetings were held to negotiate this agreement: August 31, 2018; October 24, 2018; November 14, 2018; and December 5, 2018. These meeting were attended by representatives of Leo A. Daly Company, the Construction Management Division, and the Purchasing Division.
