MOTION TO ACCEPT Deed of Conservation Easement and Agreement from the City of Fort Lauderdale for the preservation of an upland forested area comprising approximately 2.271 acres of real property located near the Fort Lauderdale Executive Airport in the City of Fort Lauderdale and authorize the Mayor and Clerk to execute same. (Commission District 9)

Why Action is Necessary
Board action is necessary to fulfill the requirements of Tree Removal License (TRL) No. TP18-1056 issued pursuant to Chapter 27 of the Broward County Code of Ordinances.

The action provides for perpetual maintenance and conservation of the mitigation site by the grantor.

Summary Explanation/Background
THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE ENVIRONMENTAL ENGINEERING AND PERMITTING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

This action supports the Board's value of encouraging investments in renewable energy, sustainable practices and environmental protection: Goal 1: Seek funding for, implement policies and pursue projects promoting the use of alternative energy, resource conservation, sustainable practices and environmental protection. Resource conservation and environmental protection is achieved by ensuring that the mitigation area will remain a natural forest in perpetuity.

The Environmental Protection and Growth Management Department (EPGMD) issued Tree Removal License No. TP18-1056 (Exhibit 3) on August 22, 2018. The license required the licensee to preserve and enhance 2.271 acres of the Natural Forest Community to mitigate for impacts to the remainder of the Natural Forest Community related to the development of a parking lot to serve airport tenants and car rental companies (Exhibit 1). The license required the conveyance of a conservation easement (Exhibit 2) to Broward County to ensure the preservation and maintenance of the 2.271 acres of enhanced Natural Forest Community in perpetuity.
