This agenda item supports the Board's goal of increased economic strength and impact of revenue-generating County enterprises balancing economic, environmental, and community needs.
Broward County recently executed Memoranda of Understanding (MOUs) with Airbnb, Inc. (approved by the Board on April 4, 2017, Agenda Item 48), and HomeAway, Inc. (approved by the Board on November 14, 2017, Agenda Item 24). The two recently executed MOUs reserve each party's rights, claims, and defenses regarding past-due tourist development taxes, and require the online platform (Airbnb or HomeAway) to collect and remit the taxes on a prospective basis commencing on a date certain.
The County is in discussions with additional online short-term accommodation rental (a.k.a. vacation rentals) platforms for similar agreements regarding the collection and remittance of tourist development taxes on rental transactions consummated through their online platforms.
This agenda item would authorize the County Administrator to execute substantively similar MOUs with additional online short-term accommodation rental platforms for the collection and remittance of tourist development taxes on a prospective basis for rentals in Broward County, subject to approval as to legal sufficiency by the Office of the County Attorney. Any material deviation in the terms and conditions would be brought before the Board for consideration prior to execution.
