CULTURAL DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTION.
This item supports the Board's value of "cultivating community culture, arts, recreation and life-long learning" and goals relating to providing diverse artistic, cultural, educational and historical amenities and programs that contribute to a vibrant, multi-cultural and economically-viable community.
Art wraps (“Wraps”) are requested in the Broward Municipal Services District (BMSD) to beautify its eight metal traffic control cabinets. The Central County Community Advisory Board (CCCAB) and Broadview Park Civic Association support this Project .
The proposed resolution is required for four of the cabinets which are owned by FDOT and located on its right-of-way in the BMSD. The remaining four cabinets are not located in the FDOT right-of-way and therefore do not require a Resolution or an agreement with FDOT.
The County will add the Wraps to the cabinets and will be responsible for all design, installation, and maintenance costs. FDOT requires the Agreement, using FDOT's standard form agreement. It is expected that the Wraps will reduce the amount of graffiti and the maintenance hours required to clean the cabinets at issue. Funds are currently allocated by the County in an amount not-to-exceed $20,000 to add the Wraps to all eight cabinets. The County's expenditure for the FDOT's cabinets will be capped at a maximum not-to-exceed amount of $10,000.
Exhibit 1 shows the location and the proposed design of the eight cabinets located within the BMSD that have been identified for Wraps. The life of the Wraps is estimated to be three years from date of installation, or longer if the Wraps remain in good condition.
The selected artist, Ruth Burotte, a Broward County resident, artist and student, attended community meetings, and met with individuals residing in the BMSD prior to designing the artwork, which will be transferred onto vinyl and affixed to the cabinets.
Ms. Ruth Burotte, who was 18 years old at the time she was selected for the Project, is the youngest commissioned artist of the Broward County's Public Art & Design Program. The artist was also required to mentor two other artists, who are also Broward residents and students.
The artwork designs were approved by the Artist Selection Panel on December 11, 2017, by the Public Art & Design Committee on December 13, 2017, and by the Broward Cultural Council on December 14, 2017.
Exhibit 2 is the Agreement required by FDOT for the County to place the Wraps on the cabinets. FDOT has indicated that it can make only limited changes to the Agreement for local issues because the agreements are uniform throughout the State. Under the Agreement’s terms: FDOT may immediately terminate the Agreement if the County does not complete the installation of the Wraps within the required time; the County must, by resolution (Exhibit 3), approve the Project and agree to fund all costs for the design, installation, and maintenance of the Project; the County must include certain indemnification provisions in its contracts with its contractor(s) and subcontractor(s), and must require its contractor(s) and subcontractor(s) to carry, specified levels of insurance. The Agreement does not include a termination for convenience by the County.
The final Agreement will be reviewed and approved as to legal sufficiency by the Office of the County Attorney prior to approval and execution by the County Administrator. The insurance requirements will be reviewed and approved by the Risk Management Division.
