This item supports the Commission's Value: Ensuring economic opportunities for all people and businesses in Broward and Goals to 1) Attract and retain all types of business, including small businesses and not-for-profits, through provision of effective incentives, technical assistance, and support, and 2) Increase the economic strength and impact of revenue-generating County enterprises balancing economic, environmental, and community needs.
This item is a modified version of what the Board approved on December 12, 2017 (Item No. 56). The differences between this agreement and the previously approved version are solely contained in Section 7 Default/Termination. While the Board approved the previous version in substantially the same form and provided authorization to the County Administrator and County Attorney to finalize and execute the agreement, the County Attorney deemed the proposed changes to be substantive and thus requiring Board approval.
The previous agreement version contained a 30-day Termination for Convenience clause that was objectionable to the City. It would be difficult for a commercial tenant to commit to a long-term office lease that relied on County parking spaces when that parking could technically be taken away after 30 days notice. The revised agreement version provides a stable lease term of six years, any time after which either Party may cancel the Agreement upon providing written notice to other Party at least one hundred eighty (180) calendar days prior to the date of termination.
The County was asked to provide the City of Fort Lauderdale with access to 200 parking spaces in the County Garage located at 151 Southwest 2nd Street, Fort Lauderdale, Florida 33301 to offer additional parking for the recruitment and retention of non-residential businesses in the downtown core of Fort Lauderdale.
County staff conducted an analysis of County parking inventory and concluded that there was excess parking inventory available beyond the needs of the County. The Agreement for Parking Access in the County Garage (Exhibit 1) provides similar access to parking spaces as that enjoyed by County employees. Under the Agreement, there are no designated spaces, but parkers may use any available space.
The County currently charges $150 month for 24 hour/7 day parking spaces. The agreement with the City is for 12 hour parking spaces (7:00 am - 7:00 pm) to accommodate businesses using downtown office space, and are appropriately priced at 50% of the prevailing County 24/7 monthly charge.
In case any last minute non-substantive issues arise and because both parties would like to conclude this agreement as quickly as possible, the motion again authorizes the Offices of the County Administrator and the County Attorney to negotiate and draft final language; and authorizes the County Administrator to execute the final agreement on behalf of Broward County. |
