MOTION TO CONSIDER enactment of an Ordinance, the title of which is as follows:

AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO DESIGN STANDARDS; AMENDING SECTIONS 5-193, 39-133, AND 39-294 OF THE BROWARD COUNTY CODE OF ORDINANCES ("CODE"), ESTABLISHING DESIGN STANDARDS IN UNINCORPORATED BROWARD COUNTY; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

ACTION:  (T-11:21 AM)  Filed proof of publication and enacted the Ordinance, as amended with the Purple-Sheeted Additional Material, dated January 9, 2018, submitted at the request of Environmental Protection and Growth Management Department to become effective as provided by law.  (Refer to minutes for full discussion.)

VOTE:  8-0.  Commissioner Geller was not present.
Why Action is Necessary
A Resolution directing the County Administrator to publish notice of public hearing to consider enactment of the Ordinance was adopted by the Board of County Commissioners at its meeting of December 12, 2017.
What Action Accomplishes
Amends Chapters 5 and 39 of the Broward County Code of Ordinances to provide for design standards within the commercial districts of unincorporated Broward County.

Summary Explanation/Background
On August 22, 2017, the Board of County Commissioners directed the Office of the County Attorney to amend the Broward County Code of Ordinances to impose design standards for the commercial districts within the unincorporated areas of Broward County.

The proposed Ordinance amends Chapters 5 and 39 of the Broward County Code of Ordinances to implement the design standards. The amendment to Chapter 39 provides design standards for commercial developments and requires owners to maintain premises in conformity with the approved site plan. The amendment to Chapter 5 requires applicants who require design review under the new design standards to submit the requisite information to allow for review.

The concept of the proposed Ordinance was presented to the Central County Community Advisory Board for consideration on August 16, 2017. The Central County Community Advisory Board made no recommendation. The Environmental Protection and Growth Management Department, as the local planning agency for the elements of the Broward County Comprehensive Plan for the unincorporated area, will hold its public hearing on December 21, 2017. At the time of preparation of this agenda item, the local planning agency public hearing has yet to occur. Accordingly, the local planning agency's recommendation regarding the Ordinance's consistency with the adopted Broward County Comprehensive Plan will be submitted as additional agenda material for the County Commission public hearing.
