Requested Action
MOTION TO APPROVE Utility Easement granting City of Fort Lauderdale a perpetual easement on a portion of County-owned property located at 325 Southwest 28th Street in Fort Lauderdale, the site of the new Broward Addiction Recovery Center, at no cost to the County subject to approval of an Opinion of Title by the City of Fort Lauderdale; authorize the Mayor and Clerk to execute the easement; and authorize recordation of same. (Commission District 7)

(Per the Tuesday Morning Memorandum, Exhibit 1 – The County Attorney and the City of Fort Lauderdale have approved the form of easement.)

Board of County Commissioners' approval is required to grant an interest in real property pursuant to Broward County Administrative Code, Section 6.23.

Summary Explanation/Background
THE PUBLIC WORKS DEPARTMENT/FACILITIES MANAGEMENT DIVISION/REAL PROPERTY SECTION RECOMMENDS APPROVAL OF THE ABOVE MOTION.

The new future Broward Addiction Recovery Center (BARC) is located at 325 Southwest 28th Street in Fort Lauderdale and identified by Folio Number 5042-22-03-0360. The new BARC facility will provide fifty beds and enhanced patient privacy in a spacious modern medical setting, conducive to rehabilitation and recovery. Water service to the facility is provided by the City of Fort Lauderdale (City). The proposed easement provides the City access to its water meter located on the County's property. The City's process requires an Attorney's Opinion of Title prior to the City's approval of the easement which has been ordered by County staff and is expected to be completed before the end of the year. The proposed easement will be recorded after the City reviews and approves the Opinion of Title.

All documents have been reviewed and approved as to form by the Office of the County Attorney.
