PUBLIC WORKS DEPARTMENT/HIGHWAY CONSTRUCTION AND ENGINEERING DIVISION RECOMMENDS APPROVAL
This item supports the Board of County Commissioners' Value of “cooperatively delivering an efficient and accessible regional intermodal transportation network" with the Goal of supporting the "development, design and construction of sustainable, multi-modal transportation facilities throughout the County, to meet the demands of residents, travelers, and businesses.”
On November 1, 2016 (Item No. 2), the Board of County Commissioners adopted Resolution No. 2016-496 supporting the NW 19th Street improvement project from State Road 7 to Powerline Road. After input from the area residents, the eastern project limit (Powerline Road) was changed to Northwest 31st Avenue.
NW 19th Street is a five-lane road under the jurisdiction of Broward County in the Cities of Lauderdale Lakes, Lauderhill and Fort Lauderdale. The Northwest 19th Street improvement project will add bicycle lanes and medians with no change to the number of vehicular travel lanes. It is a collaborative effort among Broward County, the Broward Metropolitan Planning Organization (MPO), the Florida Department of Transportation (FDOT), and the Cities of Lauderdale Lakes, Lauderhill and Fort Lauderdale. As part of this cooperative effort, FDOT will manage the design and construction administration, MPO will provide the funding for construction, and Broward County will continue to own and maintain the road after construction of the proposed improvements. The funding from the MPO excludes mowing, litter removal, and any additional costs which are Federal Aid non-participating items. These costs are the obligation of the County and have been estimated to be $1,000 for this project.
Motion A would approve a Highway Maintenance Memorandum of Agreement for the NW 19th Street improvement project. The agreement allows FDOT and its contractors to enter County right-of-way and construct the project. Additionally, this agreement provides for cooperation between FDOT and County to address utilities and unforeseen conditions. It also requires the contractor to include Broward County as an additional insured party on all insurance policies that are required by FDOT in the contractor's performance of the work.
The Broward County Administrative Code, Chapter 25, Exhibit 25.A requires all construction in Broward County right-of-way to be permitted by the Highway Construction and Engineering Division. FDOT will be designing and constructing the entire project and is requiring Broward County to waive this permit requirement in order to be consistent with its management of similar projects with other governmental agencies.
Approval of Motion B would waive the permit requirement of the Broward County Administrative Code, Chapter 25, Exhibit 25.A for this project. Staff from the Highway Construction and Engineering Division participated in the design and plan review process. Furthermore, FDOT's contracting and construction procedures are substantially equal to the County's permitting requirements and provide adequate protection for the public.
The Agreement has been reviewed and approved as to form by the Office of the County Attorney.
