Requested Action
MOTION TO DIRECT Office of the County Attorney to draft an Ordinance amending Chapter 39 of the Broward County Code of Ordinances (“Zoning Code”) related to regulations for commercial development in the Broward Municipal Services District (BMSD); specifically amending Section 39-215 "Off-street parking required," and Section 39-294 "General provisions," and to include minor updates to the  Zoning Code for clarification.

ACTION:  (T-10:51 AM)  Approved.

VOTE: 9-0.  Vice-Mayor Holness voted in the affirmative telephonically.
Why Action is Necessary
Pursuant to Section 18.5(e) of the Broward County Administrative Code, the subject matter of a proposed Ordinance must be considered by the Board prior to the drafting of the proposed Ordinance.

Summary Explanation/Background
THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE PLANNING AND DEVELOPMENT MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

Chapter 39 of the Code of Ordinances (Zoning Code) regulates the zoning for commercial uses within the BMSD. Staff recommends amending the Zoning Code requirements to promote economic development and redevelopment within existing commercial corridors, including NW 27 Avenue, Sunrise Blvd., Broward Blvd., and U.S. 441. Specifically, staff recommends revising some of the requirements for off-street parking (Section 39-215) and general provisions for Commercial Districts (Section 39-294), including design standards for commercial structures, to provide flexibility and promote the establishment of new commercial activities within existing buildings and properties. Staff will seek input on any proposed amendments from BMSD communities, including the Central County Community Advisory Board and the Broadview Park Civic Association.
