MOTION TO CONSIDER APPROVAL of New Findings of Adequacy for a plat entitled Deerfield No. 1 Plat  (065-MP-01). (Commission District 2)

ACTION:  (T-10:51 AM)  Approved the plat subject to staff’s recommendations as outlined in the Development Review Report.

VOTE: 9-0.  Vice-Mayor Holness voted in the affirmative telephonically.
Why Action is Necessary
Findings of adequacy for plats approved pursuant to Chapter 5, Article IX of the Broward County Code of Ordinances (The Broward County Land Development Code) expire five years from the approval date. New findings of adequacy must be approved by the Board of County Commissioners before a building permit can be issued.
What Action Accomplishes
Approves findings of adequacy for another five years for the plat, subject to staff recommendations and conditions assuring compliance with the standards and requirements of the Broward County Land Development Code.

Summary Explanation/Background
THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE PLANNING AND DEVELOPMENT MANAGEMENT DIVISION RECOMMEND APPROVAL, subject to staff recommendations and conditions which will assure compliance with the standards and requirements of Chapter 5, Article IX of the Broward County Code of Ordinances.
 
The applicant is requesting approval of an application for new findings of adequacy to develop on the southern 7.44 acres of the plat to be restricted to 218,000 square of office use, with no development permitted within the northern 0.92 acres designated as recreational and open space on the effective Land Use Plan. The plat was approved on June 4, 2002, for 218,000 square feet of office use, with a requirement that either a building permit be issued or infrastructure be installed by June 4, 2007. A new finding of adequacy was approved by the Board on September 9, 2008, for the southern 7.44 acres of the plat to be restricted to 218,000 square of office use with no development permitted within the northern 0.92 acres designated as recreational and open space on the effective Land Use Plan. No building permit was issued, nor infrastructure installed, by September 9, 2013, therefore the County’s findings of adequacy remain expired. See attached Development Review Report (Exhibit 1).
