Requested Action
A. MOTION TO APPROVE Contract for Sale and Purchase between Broward County (Purchaser) and Julie Aitken (Seller) of approximately three acres consisting of a single family residence located at 3801 South Flamingo Road in Davie at a purchase price of $890,000; authorize the Mayor and Clerk to execute Contract for Sale and Purchase; and authorize the Real Property Director to execute and process normal and customary title closing documents. (Commission District 5)

(Per the Tuesday Morning Memorandum, the Board's consideration of Item 12 is based on the revised contract as addressed in the Memorandum distributed as Additional Material by the Office of the County Attorney.)


ACTION:  (T-10:51 AM)  Approved with Yellow-Sheeted Additional Material, dated June 11, 2019, submitted at the request of the Office of the County Attorney.

VOTE: 9-0.  Vice-Mayor Holness voted in the affirmative telephonically.


B. MOTION TO ADOPT budget Resolution No. 2019-302 within the Parks & Land Preservation Capital Bond Fund for the Parks and Recreation Division in the amount of $930,000 for the Sale and Purchase between Broward County (Purchaser) and Julie Aitken (Seller) of a single-family residence on three acres located at 3801 South Flamingo Road in Davie and any additional closing costs. (Commission District 5)

Why Action is Necessary
A. Board of County Commissioners' approval is required to acquire an interest in real property pursuant to Broward County Administrative Code, Section 6.23.

B. Board of County Commissioners' approval is required for capital projects over $25,000.

A. Acquires property to expand Long Key Natural Area in Davie.

Summary Explanation/Background
THE PUBLIC WORKS DEPARTMENT/FACILITIES MANAGEMENT DIVISION/REAL PROPERTY SECTION AND PARKS AND RECREATION RECOMMEND APPROVAL OF THE ABOVE MOTION.

In the 1990s, Broward County began acquiring parcels to form what is now known as the Long Key Natural Area. In 2005, the County acquired approximately 15.7 acres from the Seller as an addition to Long Key Natural Area. At the time, the Seller retained a three-acre parcel that included her residence and horse stables. However, the County acquired a right of first refusal on the three acres. The Seller recently notified the County she desires to sell her property.

The Aitken house is a unique Usonian style designed in 1945 and blends in with the surrounding environment. The Dade County Pine and rustic wood beams throughout the house appear to be structurally sound with few major issues. The house will still need renovation and upkeep. The stables are a recent addition made of concrete block and built to withstand hurricanes. Parks and Recreation Division envisions the property serving as an executive retreat or day lodge in combination with the existing meeting room at the Nature Center and possibly public rental of the stables.

The property is located at 3801 South Flamingo Road in Davie and is identified by Folio Number 5040-26-00-0010. The Broward County Property Appraiser assessed this parcel for ad valorem tax purposes at $748,110 in 2019. There have been no real estate transactions involving this property in the past five years. Two appraisals were ordered which valued the property at $875,000 and $775,000 for an average of $825,000. Negotiations were completed in March 2019 for $890,000, or a purchase price of 7.9% over the appraised value. Phase 1 environmental site assessment is in progress. The County does have the option to terminate the purchase and sale agreement if environmental contamination is present or suspected.

All documents have been reviewed and approved as to form by the Office of the County Attorney.
