MOTION TO CONSIDER adoption of a Resolution No. 2019-316 Amending the Broward County Administrative Code, the title of which is as follows:

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO THE HUMAN SERVICES DEPARTMENT’S APPROPRIATIONS, FUNDING, AND FINANCIAL STATEMENTS REQUIREMENTS FOR SERVICE PROVIDERS; AMENDING SECTION 23.7 AND DELETING SECTION 23.9 OF THE BROWARD COUNTY ADMINISTRATIVE CODE (“ADMINISTRATIVE CODE”); AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE ADMINISTRATIVE CODE, AND AN EFFECTIVE DATE.

Why Action is Necessary
A Resolution directing the County Administrator to publish notice of public hearing to consider adoption of the Resolution Amending the Broward County Administrative Code was adopted by the Board of County Commissioners at its meeting of June 4, 2019.
What Action Accomplishes
Adoption of the Resolution authorizes amendments to the Broward County Administrative Code (“Administrative Code”) relating to appropriations and funding and financial statements requirements.

Summary Explanation/Background
THE HUMAN SERVICES DEPARTMENT AND THE COMMUNITY PARTNERSHIPS DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

Section 23.7 of the Administrative Code outlines the steps to be taken by the Human Services Department (“HSD”) regarding appropriations and disbursements of grant funds to human service providers, including the County Administrator's contract execution authority. The standard form agreement already references contract execution authority, therefore, HSD recommends removal of the duplicative language.

Section 23.9 of the Administrative Code provides guidelines for the submission of financial statements. The information contained in this section is addressed more specifically in the procurement document and in the applicable contracts. HSD recommends deleting Section 23.9 to remove restrictive language and to allow the procurement document or contract to dictate the service providers’ financial statements requirements. The Office of the County Auditor will be consulted regarding the financial statements requirements included in the procurement document and the standard form agreement.

The Office of the County Attorney has reviewed and approved as to form the proposed changes to the Administrative Code.
