MOTION TO CONSIDER adoption of a Resolution No. 2019-317 Amending the Broward County Administrative Code, the title of which is as follows:  

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO ENVIRONMENTAL HEALTH SERVICES FEES; AMENDING SECTIONS 36.49 AND 36.50 OF THE BROWARD COUNTY ADMINISTRATIVE CODE ("ADMINISTRATIVE CODE"); AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE ADMINISTRATIVE CODE, AND AN EFFECTIVE DATE.

Why Action is Necessary
A Resolution directing the County Administrator to publish notice of public hearing to consider adoption of the Resolution Amending the Broward County Administrative Code was adopted by the Board of County Commissioners at its meeting of June 4, 2019.

Summary Explanation/Background
THE HUMAN SERVICES DEPARTMENT AND THE COMMUNITY PARTNERSHIPS DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

The fees for the inspection of all Broward County School Board and Non-Broward County School Board facilities in Broward County are set within Section 36.49 of the Broward County Administrative Code. At the request of Florida Department of Health in Broward County (FDOHBC), the Human Services Department (“HSD”) is requesting to amend Section 36.49 of the Administrative Code to revise the existing Environmental Health Services (“EHS”) fees for inspections. The revised EHS fees for school facilities are determined by the number of students enrolled. FDOHBC compared the proposed inspection fees with the inspection fees from four health departments within the state to establish a baseline. FDOHBC will utilize revenue from the inspection fees to cover the cost of new staff to perform inspections of school facilities.

Included in the FDOHBC request was an amendment to Section 36.50 of the Administrative Code to include new fees for the review and approval of Comprehensive Emergency Management Plans (CEMP) as specified in Sections 400.497(10), 400.934(20)(b), 400.610(1)(b), and 400.506(12), Florida Statutes. On August 1, 2018, FDOHBC was directed by the state to review and approve the CEMP of 453 facilities within Broward County. The fees for the initial review of plans and subsequent annual inspections were established by FDOHBC after reviewing the fees from 66 counties. FDOHBC will utilize revenue from the CEMP fees to cover the cost of new staff to review and approve the CEMPs.

In accordance with Chapter 154, Florida Statutes, all fees collected by FDOHBC can only be used to fund County health department services.
