C. MOTION TO AUTHORIZE County Administrator to approve and execute an Agreement between Broward County and ENGIE Services U.S. Inc. (formerly known as OpTerra Energy Services, Inc.), Request for Proposals (RFP) No. R1243101P1, Energy Audit and Performance Consultant Services for Phase Two of a two-phase performance-based project, at the potential cost of $6,659,000 for implementation during the first year and an annually renewable Measurement and Verification total potential cost  of $367,000 for 16 years; for a total potential amount of $7,026,000, with a potential guaranteed savings of $7,195,000 over 16 years; to take necessary budgetary actions to consolidate existing funding into the appropriate account; in accordance with the attached ENGIE Phase Two Term Sheet and subject to the approval of the Office of the County Attorney.

MOTION TO AUTHORIZE County Administrator to approve and execute an Agreement between Broward County and Siemens Industry, Inc., Request for Proposals (RFP) No. R1243101P1, Energy Audit and Performance Consultant Services for Phase Two of a two-phase performance-based project, at the potential cost of $7,787,000 for implementation during the first year and an annually renewable Measurement and Verification total potential cost of $979,000 for 16 years; for a total potential amount of $8,766,000, with a potential guaranteed savings of $9,090,000 over 16 years; to take necessary budgetary actions to consolidate existing funding into the appropriate account; in accordance with the attached Siemens Phase Two Term Sheet and subject to the approval of the Office of the County Attorney.

Why Action is Necessary
Motions A and B - Board of County Commissioners' approval is required for the project’s Investment Grade Audit Reports to establish completion of Phase One of the two-phase agreement.

Motion C and D - Board of County Commissioners' approval is required to delegate authority to the County Administrator to enter into a legal agreement.
What Action Accomplishes
Accepts the Investment Grade Audit Reports from each company completing Phase One of a two-phase performance-based contract and authorizes the County Administrator to approve the implementation agreements and take budgetary actions to consolidate funding into the project account.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/FACILITIES MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

This item supports the County Commission’s Value: "Encouraging investments in renewable energy, sustainable practices and environmental protection"; and Goals to: 1) "Seek funding for, implement policies and pursue projects promoting the use of alternative energies, and sustainable practices; 2) Proactively lead in the planning, design, and construction of projects supporting resilience and climate adaptation, including coordination with other entities to foster resilient design as part of local and regional projects".

The Office of Economic and Small Business Development did not assign County Business Enterprise (CBE) goals for Phase One of the Energy Audit but did establish a 10% CBE participation goal for Phase Two of the Energy Audit (Exhibit 3). Both companies submitted Contractor Assurance Statements in support of the 10% Phase Two goal.

On May 23, 2017 (Item No. 32), the Board approved Request for Proposals (RFP) No. R1243101P1, Energy Audit and Performance Consultant Services agreements with OpTerra Energy Services Inc. and Siemens Industry, Inc. (Exhibits 4 and 5)

On May 8, 2019, the Director of Purchasing approved affidavit of change of name from OpTerra Energy Services, Inc. to ENGIE Services US, Inc.

Staff is finalizing contract documents and negotiations, and anticipates completion during the summer recess, and as such, is seeking to move forward with implementation to begin reductions to the County’s carbon footprint and realize savings.

Motions A and B formally accept the Investment Grade Audit Reports from each company completing Phase One for the projects.

Motion C authorizes the County Administrator to approve an Agreement between Broward County and ENGIE Services U.S. Inc. for professional services to design, permit, construct, and provide measurement and verification services for Energy Conservation Measures. These will be implemented at 35 Broward County buildings that include Court, general government, Human Services, Libraries, Mass Transit, Parks, Public Safety and Solid Waste facilities. This motion also authorizes the County Administrator to take necessary administrative budgetary actions to transfer funding from currently-funded projects that will be now be accomplished as part of this project, other existing fund balances, and contingencies. Subject to the approval of the Office of the County Attorney.

The implementation of these Energy Conservation Measures will be guaranteed to save over 3.6 million kilowatt-hours of electricity in the first year, and the production of over 690 thousand kilowatt-hours using solar panels located on top of the Government Center West Garage. This project will have a return on investment of less than 16 years. The annual Measurement and Verification scope and related cost may be changed, upon written agreement of the parties 60 days in advance of the start of each year.

Motion D authorizes the County Administrator to approve an Agreement between Broward County and ENGIE Services U.S. Inc. for professional services to design, permit, construct, and provide measurement and verification services for Energy Conservation Measures. These will be implemented at 34 Broward County buildings that include Court, general government, Human Services, Libraries, and Parks facilities. This motion also authorizes the County Administrator to take necessary administrative budgetary actions to transfer funding from currently-funded projects that will be now be accomplished as part of this project, other existing fund balances, and contingencies. Subject to the approval of the Office of the County Attorney.

The implementation of these Energy Conservation Measures is guaranteed to save over 4.7 million kilowatt-hours of electricity and over 2.9 million gallons of water in the first year, and the production of over 627 thousand kilowatt-hours using solar panel sunshades around the water park feature at C.B. Smith Park. This project will have a return on investment of less than 16 years. The annual Measurement and Verification scope and related cost may be changed, upon written agreement of the parties 60 days in advance of the start of each year.
