MOTION TO APPROVE Second Amendment to the agreement between Broward County and James B. Pirtle Company Inc., d/b/a as Pirtle Construction Company for Managing General Contractor services for New Facilities for the Human Services Department, Broward Addiction Recovery Center (BARC) Central and the Nancy J. Cotterman Center (NJCC), Request For Proposal (RFP) R1144703P1, to include the estimated Guaranteed Maximum Price 2 for the Nancy J. Cotterman Center at $11,966,369, increasing the total contract amount to $30,921,025; and extend the term of the Agreement by four years; and authorize the Mayor and Clerk to execute same. (Commission District 4)

Summary Explanation/Background
THE PUBLIC WORKS DEPARTMENT AND CONSTRUCTION MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

The Public Works Department and the Office of Economic and Small Business Development established a 24% Community Business Enterprise (CBE) participation goal for this project. Pirtle Construction Company committed to 24% participation; to date Pirtle Construction Company has been paid $16,185,366 in fees eligible for CBE participation with CBE firms receiving $4,371,418, yielding an interim achievement of 27%.

On November 12, 2013 (Item No. 51), the Board of County Commissioners approved RFP No. R1144703P1 Construction Manager at Risk for New Facilities for the Human Services Department, Broward Addiction Recovery Center (BARC) Central  and Nancy J. Cotterman Center (NJCC), allowing the option of constructing both facilities on the site between SW 3rd and SW 4th Avenues, and SW 27th Street and SW 28th Streets or constructing the facilities on separate sites. The terms and conditions set forth in the Interlocal Agreement with the City of Fort Lauderdale only allowed for the BARC Central facility to be built at the above location.

On May 19, 2015 (Item No.25), the Board of County Commissioners approved the agreement between Broward County and Pirtle Construction Company, for Managing General Contractor services to construct the Broward Addiction Recovery Center (BARC) Central, for the Guaranteed Maximum Price of $18,165,656.

On August 15, 2016, the County Administrator approved the First Amendment to the Agreement increasing the Guaranteed Maximum Price from $18,165,656 to $18,981,656. 

The Second Amendment allows for the construction of a new two-story building, approximately 28,000 square feet that will provide support services to victims of sexual assault and abuse and will replace the existing Nancy J Cotterman Center located at 400 NE 4th Street, Fort Lauderdale. The new center will be located at 2995 Dixie Highway, in the City of Oakland Park. The existing structure on Dixie Highway will be demolished to allow for the construction of the new facility.

On December 14, 2018 and on April 19, 2019 negotiation meetings were held for the Second Amendment to the Agreement to establish an estimated Guaranteed Maximum Price 2 for the Nancy J. Cotterman Center. The meetings were attended by members of Pirtle Construction and the Construction Management Division.
 
Guaranteed Maximum Price (GMP) 2 consists of the following price elements: 
a) Preconstruction Services $199,632
b) Estimated Direct Construction Cost $9,007,008
c) Estimated General Conditions Cost $1,626,075
d) Estimated Fixed Fee (5%) $531,654
e) Estimated Owner's Allowance Account $602,000

Total GMP 2 $11,966,369 

This Second Amendment has been reviewed and approved as to form by the Risk Management Division and Office of the County Attorney.
