A. MOTION TO APPROVE final ranking of the qualified firms, for Request for Proposals (RFP) No. GEN2116451P2, Group Dental Preferred Provider Organization (DPPO) Insurance. The ranked firms are 1 - UnitedHealthcare Insurance Company; 2 - Humana Insurance Company; 3 - Cigna Health and Life Insurance Company; 4 - Solstice Benefits, Inc.; 5 - Metropolitan Life Insurance Company; 6 - Delta Dental Insurance Company; 7 - Aetna Life Insurance Company and authorize staff to proceed to negotiations.

B. MOTION TO AUTHORIZE Director of Purchasing to execute the final negotiated agreement for RFP No. GEN2116451P2, Group Dental Preferred Provider Organization Insurance consistent with the estimated amount referenced in the fiscal impact.

Why Action is Necessary
A. In accordance with Broward County Procurement Code, Section 21.84.h, Selection Committee and Selection/Evaluation Committee Composition, the final recommendation of ranking requires Board action when an objection and/or protest has been filed.

B. In accordance with Broward County Procurement Code, Section 21.14.c.6, the Director of Purchasing shall execute all contracts and amendments within the Director's approval authority and agreements delegated by the Board for the Director of Purchasing's execution.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE EVALUATION COMMITTEE RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

Broward County currently offers a group Dental Preferred Provider Organization (DPPO) Insurance plan to all employees on a voluntary basis and fully paid by the employee. The Human Resources Division seeks to engage a state-certified dental insurance plan provider to offer a comprehensive DPPO insurance plan design to its benefit-eligible employees at affordable rates that will meet, at a minimum, the current plan design.

On October 23, 2018 (Item No. 38B), the Board approved the Request for Proposals (RFP) No. GEN2116451P2 Group Dental Preferred Provider Organization (DPPO) Insurance. The RFP was advertised and at the time of the opening deadline, 5:00 p.m. on November 30, 2018, seven firms submitted proposals.

On April 3, 2019, an Initial Evaluation Committee meeting was held. The Evaluation Committee determined that all seven firms were both responsive and responsible to the RFP requirements and would proceed to final evaluation.

On April 24, 2019, a Final Evaluation Committee meeting was held. After presentations, evaluation, scoring and ranking, the Evaluation Committee named Cigna Dental Health, Inc. as the first-ranked firm (Exhibit 1).

The Evaluation Committee's proposed recommendation of ranking was posted on the Purchasing Division website from April 29, 2018 through May 1, 2018, which provided an opportunity for any proposer or interested party to present any new or additional information regarding the responsibility of the proposers. 

The Evaluation Committee's final recommendation of ranking was posted on the Purchasing Division website from May 2 - 8, 2019, which provided an opportunity for any aggrieved proposer to file a formal protest.

On May 1, 2019, Laurie Mandell, Vice President of Account Management filed a timely protest on behalf of UnitedHealthcare Insurance Company (Exhibit 3), regarding the points assigned for location to Cigna Dental Health Inc.

After thorough review of the information presented in the protest, the Purchasing Division confirmed that Cigna Health and Life Insurance Company, not Cigna Dental Health, Inc., as indicated by Cigna’s representative, is the correct entity to provide DPPO coverage for the County. The Purchasing Division further confirmed in Sunbiz.org. that Cigna Health and Life Insurance Company has a principal business address of 900 Cottage Grove Road, Bloomfield, CT 06002 and on May 17, 2019, the Director of Purchasing issued a response in which the protest was upheld (Exhibit 4).

In accordance with the RFP requirements, the Evaluation Criteria for Location states that a vendor with a principal place of business location (also known as the nerve center) within Broward County will receive five points and that a vendor not having a principal place of business in Broward County will receive zero points.

At the Final Evaluation, five points for location were allocated to Cigna. Given that the principal location for Cigna Health and Life Insurance Company is in Bloomfield, CT, the five points for location were incorrectly allocated to Cigna Dental Health, Inc.

On May 20, 2019, a Reconvened Final Evaluation Committee meeting was held at which time the Evaluation Committee re-scored and re-ranked the seven firms to the following updated ranking: 1) UnitedHealthcare Insurance Company 2) Humana Insurance Company 3) Cigna Health and Life Insurance Company 4) Solstice Benefits, Inc. 5) Metropolitan Life Insurance Company 6) Delta Dental Insurance Company and 7) Aetna Life Insurance Company, (Exhibit 5).

The Evaluation Committee's proposed recommendation of the revised ranking was posted on the Purchasing Division website on May 21, 2018, which provided an opportunity for any proposer or interested party to present any new or additional information. No information was submitted.

The Evaluation Committee's revised final recommendation of ranking will be posted on the Purchasing Division website from May 24 - 31, 2019, which provides an opportunity for any aggrieved proposer to file a formal protest. In the event that a protest is received this item will be pulled for further staff review.
