Why Action is Necessary
In accordance with Section 21.10.a. of the Procurement Code based upon the written recommendation of the County Administrator, the Board of County Commissioners may elect to waive the Procurement Code and serve as the direct procurement authority for the procurement of specified goods or services.

In accordance with Section 21.6.c. of the Board may waive all or specific provisions of this Procurement Code for good cause, prior to the solicitation of offers, or may waive specific provisions of this Procurement Code as is in the best interest of the County, at any point in the procurement process

The Interlocal Agreement with the City of Fort Lauderdale requires this action. Board approval is required to designate the Board to serve as the Direct Procurement Authority jointly with the City of Fort Lauderdale City Commission.

Summary Explanation/Background
This action supports the Commission Goal of "Consistently and effectively market and brand Broward County programs and services, locally and globally, through effective collaboration."

At a joint workshop of the Broward County Board of County Commissioners (Board) and the City Of Fort Lauderdale City Commission (Commission) (jointly the Parties) held on May 9, 2017, the members of the Board and Commission unanimously supported the idea of moving forward with the development of a joint government center campus in downtown Fort Lauderdale (Project) to serve as the new offices for both the City and the County. A Working Group (WG) was appointed to help advance the Project.

At the May 7, 2019 Regular Meeting (Item No. 76), the Board approved an Interlocal Agreement (ILA) with the City of Fort Lauderdale (Exhibit 2) which establishes that the Parties are desirous of working together on the joint development of the Project to be located on the site of the County's downtown bus terminal, immediately adjacent to Broward Boulevard. The ILA establishes a basic framework for the oversight of the procurement and development process of the Project, including the designation of the Board and Fort Lauderdale City Commission to act jointly as the Direct Procurement Authority. All decisions of the Unified Direct Procurement Authority (UDPA) will require a majority of the respective memberships of the Board and Commission. The ILA provides for the procurement of a design consultant to perform a space needs assessment and develop a design criteria package, the cost of which will be shared 50/50 by the Parties. The ILA further provides that future cost sharing will be on a proportional basis.

In accordance with Section 21.10 of the Broward County Procurement Code, the Board may serve as the Direct Procurement Authority, based on recommendation of the County Administrator. Because of the extraordinary community impacts of this project, and to provide greater transparency for this procurement process, the County Administrator has recommended to the Board of County Commissioners that it serve, collectively with the City of Fort Lauderdale City Commission, as the Direct Procurement Authority (Exhibit 1). The waiving of the Procurement Code by the Board allows for the establishment of the UDPA and allows the County and the City to jointly determine how best to move forward with procurements related to the Project.
