Requested Action
A. MOTION TO AUTHORIZE Director of Purchasing to increase contract threshold amounts based on the approved budgets for the County Agency and execute any amendments that may be necessary, for contracts listed in Exhibit 1, in excess of the current delegated authority of the Director of Purchasing and County Administrator, for use on Surtax Supported Mobility Advancement Program projects. Any amendment approvals will be subject to the Office of the County Attorney approving as to legal sufficiency.

(Per the Tuesday Morning Memorandum, Exhibit 1 – The following contracts should be removed from the requested threshold increase list:
  • PNC2117217B1 Bridge and Miscellaneous Structures Repairs
  • N2113654B1 Sidewalk and Drainage Repair)
ACTION:  (T-11:16 AM)  Approved.

VOTE:  8-0.  Commissioner Sharief was not present.


B. MOTION TO WAIVE Broward County Procurement Code, Section 21.85.f.3 requirement limiting the total annual cumulative fees for Consultants' Competitive Negotiation Act (CCNA) continuing contracts to not exceed $1,000,000 for construction-related projects, $500,000 for a study activity, and $500,000 for "work of a specified nature" for any agreements (current or future) used for Surtax Supported Mobility Advancement Program projects.

Why Action is Necessary
A. In accordance with the Broward County Procurement Code, Section 21.14.d, Board of County Commissioners’ approval is required to delegate authority to the Director of Purchasing for awards, threshold increases, amendments, and extensions/renewals, greater than the Director of Purchasing’s execute authority.

B. Broward County Procurement Code, Section 21.6.c, requires Board of County Commissioners’ approval to waive any provisions of the Procurement Code.
What Action Accomplishes
A. Authorizes the Director of Purchasing to increase contract thresholds or agreement limits for contracts listed in Exhibit 1 that will be used for the Surtax Supported Mobility Advancement Program projects.

B. Eliminates the Broward County Procurement Code requirement limiting the total annual cumulative fees for continuing contracts for the Surtax Supported Mobility Advancement Program projects.

Summary Explanation/Background
THE PURCHASING DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTIONS.

On November 6, 2018, Broward County voters approved a referendum for a penny surtax for transportation. The surtax will fund countywide transportation projects to improve transportation mobility in all 31 municipalities and include improvements to traffic signalization, County roadways, intersection improvements, senior mobility options, public transportation (bus and rail) and to fund future investments in Broward’s transportation system. The new surtax took effect on January 1, 2019 in Broward County.

Exhibit 1 is the list of contracts which can be used for Surtax Supported Mobility Advancement Program projects. Allowing the Director of Purchasing to increase thresholds or execute amendments to increase the contract amount to the approved capital budgeted amount for Surtax Supported Mobility Advancement Program projects will provide for expedited procurements for these projects.

Motion B requests approval to waive the Broward County Procurement Code, Section 21.85.f.3, which limits the total annual cumulative fees for a continuing contract to not exceed $500,000 for study activities covered by Florida Statutes, Chapter 287.055, Consultants' Competitive Negotiation Act (CCNA). The total annual cumulative fees for agreements for Mobility Advancement Program projects are expected to be greater than the Procurement Code limits. The CCNA limits included in the Procurement Code are not required by State Statute. The CCNA state statute requirements will be followed for continuing contracts, including limiting design for construction projects less than $2,000,000.
