Roam Rental Car of Fort Lauderdale LLC, d/b/a Ace Rent A Car, and authorize staff to proceed with negotiations with all four firms for Package C (2 slots - C1 and C2) and Package D (two slots - D1 and D2) in accordance with the terms of the RFP and contingent upon no protest being timely filed by close of business on May 22, 2019.

Summary Explanation/Background
THE AVIATION DEPARTMENT AND THE EVALUATION COMMITTEE RECOMMEND APPROVAL OF THE ABOVE MOTION.

This action approves the Evaluation Committee's recommendation of the final ranking of qualified firms.

This procurement was solicited to engage the services of qualified firms for the operation of various non-exclusive on-airport automobile rental concessions from the Rental Car Center ("RCC") at Broward County's Fort Lauderdale-Hollywood International Airport ("FLL").

On November 13, 2018 (Item No. 70), the Board approved Request for Proposals No. 20180430-0-AV-01 ("RFP") for On-Airport Rental Car Concession at FLL. The RFP is only for Packages C and D, which consist of a total of four separate proposed spaces: C1, C2, D1, and D2 (Exhibit 1).

The RFP states that the County may award up to two agreements for Package C (2 slots - C1 and C2) and up to two agreements for Package D (2 slots - D1 and D2), as further stated in the RFP. The eligible successful proposer with the highest point total for Package C will be allowed to select one of the two locations (C1 or C2); the next highest eligible successful proposer will accept the remaining space in Package C. The eligible successful proposer with the highest point total for Package D will be allowed to select one of the two locations (D1 or D2); the next highest eligible successful proposer will accept the remaining space in Package D. The packages will be awarded in alphabetical order (the slots in Package C first and then the slots in Package D), and only one package slot will be awarded per proposer. Therefore, once a proposer is awarded a package slot, additional submittals from that proposer, if any, will not be given further consideration for a subsequent package slot.

On January 29, 2019 (Item No. 14), the Board authorized the Director of Aviation to negotiate new Rental Car Concession Lease and Operating Agreements for Packages A and B with the three major car rental groups that are currently at the RCC, representing nine separate brands: (1) Enterprise Holdings, Inc., d/b/a Enterprise Rent-A-Car, National Car Rental, and Alamo Rent a Car; (2) The Hertz Corporation d/b/a Hertz Rent a Car, Thrifty Car Rental, and Dollar Rent A Car; and (3) Avis Budget Group d/b/a Avis Rent a Car, Budget Rent A Car, and Payless Car Rental (Exhibit 1).

The RFP for Package C and D was advertised, and at the time of the opening deadline at 4:30 p.m. on February 27, 2019, the following five firms submitted proposals: 1) Fox Rent A Car, Inc., ("Fox Rent A Car") (Package C and Package D); 2) Sixt Rent A Car, LLC ("Sixt Rent A Car") (Package C and Package D); 3) Roam Rental Car of Fort Lauderdale LLC, d/b/a Ace Rent A Car ("Ace Rent A Car") (Package D only); 4) Advantage Opco, LLC, d/b/a Advantage and EZ Rent A Car ("Advantage/EZ Rent A Car") (Package D only); and 5) ER Travel LLC, d/b/a Easirent ("Easirent") (Package D only).

On April 22, 2019, an Initial Evaluation Committee meeting was held. At the Initial Evaluation meeting, three of the five firms were determined to be both responsive and responsible to the RFP requirements and proceeded to the Final Evaluation Committee meeting. The three firms were: 1) Fox Rent A Car (Package C and Package D); 2) Sixt Rent A Car (Package C and Package D); and 3) Ace Rent A Car (Package D only). Both Advantage/EZ Rent A Car and Easirent were determined to be non-responsible.

On May 3, 2019, Advantage/EZ Rent A Car submitted a Letter of Reconsideration to the Director of Purchasing, requesting that they be found responsible to the Airport Concession Disadvantaged Business Enterprise ("ACDBE") requirements and be allowed to present. In support of their request, Advantage/EZ Rent A Car submitted letters of intent. This letter was forwarded to the Office of Economic and Small Business Development, which, per the requirements of County Administrative Procedure Volume 14, Chapter 1, Disadvantaged Business Enterprise Administrative Reconsideration, requested the assignment of a Reconsideration Officer for the RFP, consistent with the requirements of Title 49 CFR 26.53. The Reconsideration Officer reviewed the matter on May 6, 2019, and determined that Advantage/EZ Rent A Car was compliant with the ACDBE requirements.

On May 7, 2019, a Final Evaluation Committee meeting was held. During the meeting, a motion to reconsider was passed, and Advantage/EZ Rent A Car was found responsible with the ACDBE requirements. Advantage/EZ Rent A Car was then allowed to present. After presentations, evaluation, and scoring, the Evaluation Committee ranked the firms as follows; Package C: 1. Sixt Rent A Car and 2. Fox Rent A Car (Exhibit 2) and Package D: 1. Advantage/EZ Rent A Car and 2. Ace Rent A Car. (Exhibit 3).

In accordance with the terms of the RFP, Sixt Rent A Car and Fox Rent A Car were excluded from the ranking for Package D because they were the two highest ranked firms for Package C.

The Evaluation Committee's proposed recommendation of ranking will be posted on the Broward County Aviation Department's ("BCAD") website from May 9, 2019 through May 14, 2019, which provides an opportunity for any proposer or interested party to present any new or additional information regarding the responsibility of the proposers. At the time of agenda submission, there was no additional information submitted.

If there is no additional information submitted during the objection timeframe, the Evaluation Committee's final recommendation of ranking will be posted on the BCAD website from May 15, 2019 through May 22, 2019, which provides an opportunity for any aggrieved proposer to file a formal protest. 

Staff will proceed with negotiations with Sixt Rent A Car and Fox Rent A Car for Package C (2 slots - C1 and C2), and with Advantage/EZ Rent A Car and Ace Rent A Car for Package D (2 slots - D1 and D2) in accordance with the terms of the RFP if (1) no protest is timely filed by close of business on May 22, 2019; (2) the Board approves this final ranking; and (3) County staff substantially agrees to the terms for Packages A and B with (1) Enterprise Holdings, Inc., d/b/a Enterprise Rent-A-Car, National Car Rental, and Alamo Rent a Car; (2) The Hertz Corporation d/b/a Hertz Rent A Car, Thrifty Car Rental, and Dollar Rent A Car; and (3) Avis Budget Group d/b/a Avis Rent a Car, Budget Rent A Car, and Payless Car Rental.
