MOTION TO AWARD open-end contract to single bidder, Laws Reporting, Inc., for Real Time Captioning and Reporting/Recording Services, Bid No. GEN2117620B1, for the Records, Taxes and Treasury Division, for an initial two-year term, in the estimated amount of $102,850 annually, and authorize the Director of Purchasing to renew the contract for three one-year periods, for a five-year potential estimated amount of $514,250. The initial term of the contract will begin on June 7, 2019 and will terminate two years from that date.

ACTION:  (T-11:16 AM)  Approved.

VOTE:  8-0.  Commissioner Sharief was not present.
Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.31.a.4, Award Authority, Board approval is required for awards exceeding $500,000 that includes a single bidder, rejection of apparent low bidder, or protested award.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE FINANCE AND ADMINISTRATIVE SERVICES DEPARTMENT/RECORDS, TAXES AND TREASURY DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

The Office of Economic and Small Business Development Division did not assign Small Business Enterprise (SBE) or County Business Enterprise (CBE) goals for this project because there were no subcontracting opportunities for SBE or CBE contractors (Exhibit 2).

The purpose of this contract is to provide real-time captioning and reporting/recording services for televised Commission Meetings and for non-televised Commission Meetings, such as Advisory Board Meetings and Board Workshops.

In an effort to solicit additional bidders, vendor outreach was performed; however, the solicitation resulted in the receipt of a single bid by Laws Reporting, Inc. and two declinations.

The Records, Taxes and Treasury Division has reviewed the bid submitted by Laws Reporting, Inc. and concurs with the recommendation for award (Exhibit 3). Two vendor performance evaluations have been completed for Laws Reporting, Inc.; the firm has an overall rating of 4.57 out of a possible 5. Copies of the vendor performance evaluations are available upon request.

The Purchasing Division has researched the prices submitted by the recommended bidders, Laws Reporting, Inc., and has determined that the prices submitted are fair and reasonable in comparison to the previous Broward County contract (Exhibit 4).

Incumbent: Laws Reporting, Inc., Contract No. N1376702B1, Real-Time Caption & Record; Contract Term: March 9, 2016 through June 6, 2019. Expenditures to date: $323,572.25.

There was no protest or appeal filed regarding this procurement.

The bid posted on March 13, 2019 and opened on March 22, 2019; one bid was received with two declinations (Exhibit 1).
