MOTION TO APPROVE Third Amendment to the Agreement between Broward County and Finn Partners, Inc., for Public Relations Services (“Agreement”) for the Greater Fort Lauderdale Convention & Visitors Bureau (“GFLCVB”), Port Everglades, and the Aviation Department; extending the Agreement for an additional six-month term from October 1, 2019 through March 31, 2020, with up to six additional month-to-month extensions thereafter in the discretion of the GFLCVB President, with a maximum not-to-exceed amount determined by the 2020 Fiscal Year advertising budget for the department at issue; and authorizing the Mayor and Clerk to execute same.

Why Action is Necessary
Based on the amounts of previous amendments to the Agreement, the Third Amendment will exceed the Purchasing Director’s Execution Authority as described in Section 21.14(d)(2) of the Broward County Administrative Code.

Summary Explanation/Background
THE GFLCVB AND PURCHASING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

The GFLCVB is requesting approval of the Third Amendment, extending the Agreement for a minimum of six months and a maximum of 12 months from its current expiration date of September 30, 2019.

The Agreement’s initial term was from October 1, 2014, through September 30, 2017. The Agreement included two one-year renewals that the County has exercised, with the final renewal period ending on September 30, 2019. The Agreement provided for Finn Partners to provide public relations services (and, via a subsequent amendment, increased social media services) to the GFLCVB in amounts approved by the Board as part of the annual budget process. Additionally, the Agreement authorized Port Everglades and the Aviation Department to utilize Finn Partners for public relations services at an hourly rate, subject to limitations in their annual advertising budgets.

This extension will allow for the GFLCVB to have continued public relations services beyond the Agreement’s current September 30, 2019 expiration, and allow Port Everglades and the Aviation Department access to Finn’s public relations services at the rate provided in the Agreement.

There is no specific maximum amount stated in the Third Amendment; instead GFLCVB, Port Everglades, and Aviation Department expenditures for public relations services under the Agreement are limited based upon their annual advertising budgets for the 2020 Fiscal Year. GFLCVB’s budget for public relations services under the Agreement for the 2019 Fiscal Year was $650,000.

The extension also allows additional time to complete the RFP process to procure a public relations services vendor and execute a new contract. A Motion to Approve the new RFP solicitation will be forthcoming for Board review and approval.
