THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE PLANNING AND DEVELOPMENT MANAGEMENT DIVISION RECOMMEND APPROVAL, subject to staff recommendations and conditions which will assure compliance with the standards and requirements of Chapter 5, Article IX of the Broward County Code of Ordinances.
On October 23, 2018, the Board approved a Plat Note Amendment for Parker Plat (100-MP-88) in the City of Wilton Manors (Exhibit 1). The City of Wilton Manors approved the amendment by Resolution 2018-086. The development will be known as “Equality Park” and will provide affordable housing for special needs seniors.
The Board approved Plat Note Amendment allocated 60,000 square feet of community facility and 48-aged restricted mid-rise units to Parcel A. Subsequently, during the title search, it was determined that the developer, Gay and Lesbian Community Center of Greater Fort Lauderdale, does not have complete control of Parcel A. A small and un-buildable land of only 146 square feet within Parcel A, is owned by the adjacent property owner to the south.
The purpose of this item is to remove the 146 square foot of un-buildable land and to allocate all the entitlements previously approved by the Board on October 23, 2018, to the remainder of the land (to be known as Parcel A-1). Sketch and Legal descriptions for revised Parcels A, A-1, and B are attached as Exhibit 2. In addition, the design of the four story building, approved by the City of Wilton Manors, does not include any residential units on the first floor. Therefore, it is also requested to change the unit type from mid-rise to garden apartment, with no change in total number of units (48 units). In a market rate product, such a change would require additional concurrency review and assessment of impact fees. However, as an age-restricted affordable housing project, this development is exempt. Therefore, given that no change in circumstances has occurred since the review of the land and Board Action on October 23, 2018, the Director of Planning and Development Management has waived further agency review in accordance with Section 5-181(c)(1) of the Land Development Code.
Staff recommends approval of the revised legal description for Parcels A, A-1, and B; and approval of the plat note for Parcel A-1 subject to staff recommendations and conditions assuring compliance with the standards of the Land Development Code as approved in Exhibit 1, with the plat note now revised to “48-age restricted garden apartment units” in lieu of “48-age restricted mid-rise units.” |
