MOTION TO DISCUSS potential violation of employee retention requirements by EULEN America. (Mayor Bogen)

ACTION:  (T-10:35 AM)  Following discussion, the Board asked Aviation Director Mark Gale to provide a report to the Board prior to the next Commission Meeting, as well as to convey the sentiments of the majority of the Board. In addition, the Board requested that Aviation Director Mark Gale send a notice of noncompliance by close of business today so as to officially set a 30-day period.  Further, the Board requested that a Notice of Noncompliance item come back to the Board at the next Commission Meeting.  (Refer to minutes for full discussion.)

Summary Explanation/Background
EULEN America, an airline service provider working for various airlines, was recently engaged by Delta Airlines for the provision of Porter Service and Wheelchair Escorts at Terminal 2 of the Fort Lauderdale-Hollywood International Airport. The Service Employees International Union has indicated that some of the employees working for the prior contractor, Bags, Inc., have not been retained as employees of EULEN America.

Section 26.41 of the Broward County Administrative Code requires that contractors providing certain services, including Porter Service and Wheelchair Escorts for air carriers, comply with certain employee retention requirements. For contracts longer than six months, the contractor must offer continued employment to the employees of the immediately preceding contractor for a period of 45 days, unless the contractor demonstrates to the County that such employees are unnecessary for the provision of services. The requirements of Section 26.41 are included in the County’s contracts with its airline service providers. Failure of the airline service provider to comply with the employee retention requirements within 30 days after written notice is a basis for termination of the applicable service provider contract.

This item permits discussion by the Board of County Commissioners regarding the contractor’s compliance with the applicable employee retention requirements.
