MOTION TO ADOPT Resolution No. 2019-284 directing the County Administrator to publish Notice of Public Hearing to be held on Tuesday, June 4, 2019, at 10:00 a.m., in Room 422 of the Governmental Center to consider enactment of a proposed Ordinance, the title of which is as follows:

AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO TREE MAINTENANCE; AMENDING CHAPTERS 8½, 27, AND 39 OF THE BROWARD COUNTY CODE OF ORDINANCES ("CODE") TO DELETE VIOLATIONS RELATED TO TREE MAINTENANCE AND TO REPEAL SUNSETTED PROVISIONS; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

Why Action is Necessary
The proposed Ordinance was prepared by the Office of the County Attorney at the direction of the Board of County Commissioners at its meeting of April 16, 2019.
What Action Accomplishes
Amends the Broward County Code of Ordinances to delete violations related to tree maintenance and to repeal sunsetted provisions.

Summary Explanation/Background
On May 8, 2018, the Board enacted Ordinance No. 2018-22, which amended Chapters 8½, 27, and 39 of the Code to, among other things, penalize property owners in unincorporated Broward County that fail to properly maintain trees that were planted near power lines prior to the Ordinance's effective date. In addition, the Ordinance created one (1) year programs intended to assist property owners to meet the newly imposed obligations.

On April 16, 2019 (Agenda Item 52), the Board directed the Office of the County Attorney to draft an Ordinance to remove the penalties for failing to maintain these trees and to remove expired Code sections. The attached proposed Ordinance accomplishes those purposes.
