Requested Action
MOTION TO AWARD open-end contract to a single bidder, General Asphalt Co., Inc. for Annual Civil Repairs and Maintenance, Bid No. PNC2117536C1, for the Aviation Department, in the annual estimated amount of $5,916,455, and authorized the Director of Purchasing to renew the contract for two one-year periods, for a three-year potential estimated amount of $17,749,365. The initial contract shall begin on the date of award and will terminate one year from that date, contingent upon the receipt and approval of insurance/performance and payment guaranty and authorize the Mayor and Clerk to execute same.

Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.31.a.4, Award Authority, Board approval is required for awards exceeding $500,000 that includes a single bidder, rejection of apparent low bidder, or protested award.
What Action Accomplishes
Provides for all labor, materials, and equipment to complete airfield and landside civil work for Broward’s Fort Lauderdale-Hollywood International Airport.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE AVIATION DEPARTMENT RECOMMEND APPROVAL OF THE ABOVE MOTION.

The Office of Economic and Small Business Development (OESBD) established a County Business Enterprise (CBE) participation goal of 35% for this contract. General Asphalt Co., Inc. committed to 35.64% CBE participation goal, which has been reviewed and approved by the OESBD (Exhibit 2).

The purpose of the contract is to provide all labor, materials and equipment to complete airfield and landside civil site work and repairs for Broward’s Fort Lauderdale-Hollywood International Airport.

This procurement carries a 25% performance and payment guaranty; however, when an individual purchase order is greater or the cumulative in progress work orders exceed the 25% bond amount, an increase of the bonds to match the cumulative amount of work will be required within seven business days of notification by the County. The Purchasing Division has confirmed with the surety company that General Asphalt Co., Inc. has the capacity to obtain the required guaranty.

In accordance with the Broward County Workforce Investment Program, Broward County Administrative Code, Section 19.211 these services are subject to the Workforce Investment Program. General Asphalt Co., Inc. agrees to be bound to the contractual obligations of the Workforce Investment Program.

The Aviation Department has reviewed the bids submitted by General Asphalt Co., Inc. and concurs with the recommendation for award. Four performance evaluations have been completed for General Asphalt Co., Inc. The firm has an overall rating of 4.15 out of a possible 5.0. Copies of the vendor’s performance evaluations are available upon request (Exhibit 3).

Staff has researched the prices submitted by the recommended bidder, General Asphalt Co., Inc., and has determined that the prices submitted are fair and reasonable (Exhibit 4).

Previous Contract: General Asphalt Co., Inc. (Primary Contractor) and Weekley Asphalt Paving, Inc. (Secondary Contractor); Agreement Number and Title: Z1363904C1, Annual Civil Repairs and Maintenance – 2015; Contract Term: December 9, 2015 and expired on March 9, 2019. Expenditures to date: $4,046,674.

Interim Contract No. PNC2117536X1, the Director of Purchasing approved the Annual Civil Repairs and Maintenance with General Asphalt Co., Inc. in the amount of $400,000 utilizing the same pricing, terms and conditions as Solicitation No. PNC2117536C1 in order to provide the referenced services from March 25, 2019 to June 23, 2019.

The amounts referenced in this agenda item were rounded to the nearest whole dollar. Vendor payments will be based on the actual total bid amount. The bid tabulation reflects the actual amount of the award.

The bid validity for this project expired on March 16, 2019. General Asphalt Co., Inc. has agreed to extend its bid validity through June 14, 2019 for Bid No. PNC2117536C1.

The bid posted on October 16, 2018 and opened on November 16, 2018; one bid was received with three declinations (Exhibit 1). Prior to the bid opening, staff conducted vendor outreach, it was indicated from two vendors, Weekley Asphalt Paving, Inc. and Community Asphalt Corp., that due to their workload they would not be submitting a bid.  

There was no protest or appeal filed regarding this procurement.
