MOTION TO RETROACTIVELY TERMINATE Agreement with Quest Diagnostics Incorporated (Quest) for laboratory testing services effective as of December 31, 2018, in light of the inclusion of Quest in the network for the County's healthcare contract with UnitedHealthcare (UHC) as of January 1, 2019.

ACTION:  (T-11:36 AM)  Approved.

VOTE: 9-0.  Commissioner Geller voted in the affirmative telephonically.

Board approval is required in accordance with Broward County Procurement Code, Section 21.122, to terminate a contract or rescind an award made by the awarding authority.

Summary Explanation/Background
THE FINANCE AND ADMINISTRATIVE SERVICES DEPARTMENT, THE HUMAN RESOURCES DIVISION AND THE PURCHASING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

On May 2, 2017 (Item No. 6), the Board of County Commissioners approved the agreement with Quest for laboratory testing services (“Agreement”). The Agreement provided for continuity of access to Quest laboratory testing services for members enrolled in a County health plan under UHC. The County, through its third party administrator, UHC, compensated Quest for such laboratory testing services.

Previously, a separate agreement with Quest was necessary because Quest was not in the network of the County's health care provider, UHC. However, effective January 1, 2019, Quest is now in UHC’s network and therefore provides the same services under the UHC contract with the County. The separate agreement with Quest is no longer necessary. There will be no disruption of services by Quest resulting from this technical termination. 

The Director of Purchasing recommends that the Agreement be terminated in accordance with its terms. Quest has agreed to the proposed termination of Agreement with a retroactive, effective termination date of December 31, 2018.
