B. MOTION TO APPROVE Third Amendment to Work Authorization No. HS0745 under the Agreement between Broward County and Hazen and Sawyer, P.C., for General Consultant Services for Water and Wastewater Services, RLI No. 20060911-0-EED-1, for additional engineering services during construction related to the Supervisory Control and Data Acquisition (SCADA) System Replacement at the North Regional Wastewater Treatment Plant in the amount of $219,000, with an increase in time for performance of 540 calendar days, resulting in a revised Work Authorization maximum not-to-exceed amount of $1,017,932 and revised time for performance of 2,780 calendar days; and authorize the Mayor and Clerk to execute the same. (Commission District 4)

Summary Explanation/Background
 THE PUBLIC WORKS DEPARTMENT/WATER AND WASTEWATER SERVICES RECOMMENDS APPROVAL OF THE ABOVE MOTIONS.

The Office of Economic and Small Business Development established a County Business Enterprise (CBE) participation goal for this Agreement of 20%. Hazen and Sawyer, P.C. committed to a 20% CBE participation. A CBE participation goal of 10% was established for this Work Authorization. Hazen and Sawyer, P.C. projects that they will achieve their original goal of 20% CBE participation with the completion of the additional services contained in this Agreement. As of December 3, 2018, Hazen and Sawyer, P.C. has been paid $9,501,563 with the CBE receiving $1,771,966, yielding 19% participation (Exhibit 1).

On June 24, 2008 (Item No. 28A), the Board of County Commissioners approved the Agreement between Broward County and Hazen and Sawyer, P.C., for General Consultant Services for Water and Wastewater Services (Exhibit 2), for a total not-to-exceed amount of $3,000,000 per year for two years from the date of execution, with three one-year extensions, which rendered the contract with an expiration date for new Work Authorizations of June 24, 2013. The Agreement limits professional engineering fees associated with any individual work authorization, including any amendments thereto, to a maximum fee of $800,000. The authorized professional fee for this Work Authorization is currently $798,932. The proposed Third Amendment to Work Authorization HS0745, in the amount of $219,000, would exceed this limit for a single work authorization. Motion A for the First Amendment to the Agreement (Exhibit 4), will extend the term of the Agreement to June 24, 2020 and increase the limit amount of all professional engineering fees associated with an individual Work Authorization from $800,000 to $1,200,000 and extend the term of the Agreement by 2,557 calendar days, to June 24, 2020, for a total time for performance of 4,383 calendar days to provide the required time to complete the project.

On May 8, 2012, Work Authorization HS0745 (Exhibit 3) was issued for engineering design and services during construction for the replacement of the SCADA system at North Regional Wastewater Treatment Plant. Subsequent amendments (first and second) extended the expiration date to August 6, 2018. During construction it was found that an increased level of effort was required to integrate the SCADA software and screens from the factory acceptance tests into live onsite testing and equipment commissioning. These difficulties could not have been anticipated by the contractor. In addition, the contractor experienced the loss of key personnel which caused some progress delay. Therefore, additional engineering services were needed to provide oversight and guidance to the contractor’s programming team to ensure computer screens match closely to actual field conditions and provide assistance with process flow diagrams and regulatory permit requirements. Motion B for the Third Amendment to Work Authorization No. HS0745 (Exhibit 5), will increase the Work Authorization amount by $219,000, for a total maximum not-to-exceed amount of $1,017,932 and will extend the expiration date by 540 calendar days to January 28, 2020 for a revised time for performance of 2,780 calendar days. 

This Third Amendment was negotiated in Sunshine meetings held on August 14, 2018, August 24, 2018, and August 29, 2018, attended by representatives from Hazen and Sawyer, P.C. and County staff. Both Amendments were reviewed and approved as to form by the Office of the County Attorney and Risk Management Division.

Fiscal Impact/Cost Summary:
The estimated amount of this agreement is $219,000. Each requirement processed against individual work authorizations will be funded by the appropriate source at the time of issuance.
