Requested Action

A. MOTION TO AUTHORIZE County Administrator to execute the Second Amendment to Agreement No. 19-CP-HIP-8470-01 between Broward County and Broward Partnership for the Homeless, Inc. ("BPHI"), subject to approval by the Office of the County Attorney, for an amount not-to-exceed $779,378, increasing the Agreement amount from $5,751,090 to $6,530,468, for Program 3, North Homeless Assistance Center ("NHAC"), from April 1, 2019 to September 30, 2019 for one-time capital expenses associated with the delivery of services to individuals and families experiencing homelessness in Broward County; and authorize the County Administrator to take all necessary administrative and budgetary actions to implement the Agreement.

VOTE: 9-0.  Commissioner Geller voted in the affirmative telephonically.


B. MOTION TO APPROVE waivers of conflict under Section 112.313(7)(a), Florida Statutes, for the following Broward County advisory board members holding an employment or contracting relationship with an entity receiving funds for the performance of homeless services under this agenda item.

VOTE: 9-0.  Commissioner Geller voted in the affirmative telephonically.
Why Action is Necessary
A. Amendments to Agreements that increase funds by more than 10 percent must be approved by the Board.

B. A waiver of conflict arising under Section 112.313(7)(a), Florida Statutes, requires two thirds approval by the Board in accordance with Section 112.313(12), Florida Statutes.
What Action Accomplishes
Motion A provides capital funding necessary to operate the NHAC for shelter and day respite services to individuals and families experiencing homelessness.

Motion B waives the existence of any conflicts arising under Section 112.313(7)(a), Florida Statutes, as authorized under applicable law.

Summary Explanation/Background
THE HUMAN SERVICES DEPARTMENT AND THE COMMUNITY PARTNERSHIPS DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

These actions support the Commission Value: "Approaching human services collaboratively and compassionately, with special emphasis on the most vulnerable" and the Commission Goal: "Collaborate with public and private partners to find creative, equitable, and responsible solutions to systemic community problems, especially permanent, supportive housing for persons experiencing, or at risk of, homelessness." Funding will allow the NHAC to provide temporary shelter and supportive services to families and individuals experiencing homelessness in Broward County.

On January 29, 2019, (Item No. 22), the Broward County Board of County Commissioners authorized the County Administrator to execute the First Amendment to Agreement No. 19-CP-HIP-8470-01 between Broward County and BPHI, to provide emergency shelter and day respite services to Broward County families and individuals experiencing homelessness. This funding will enable BPHI to purchase materials necessary to implement the shelter and day respite services at the NHAC.

Because this is the first year that BPHI will be operating the NHAC, there are no outcomes to report. The Amendment will be reviewed and approved by the Office of the County Attorney prior to execution by the County Administrator.

Approval of this item would give rise to certain employment conflicts under Section 112.313(7)(a), Florida Statutes, which provides that "no public officer...shall have or hold any employment or contractual relationship with any business entity...which is doing business with an agency of which he or she is an officer or employee." In accordance with Section 112.313(12), Florida Statues, Board approval is required to waive any conflict arising under Section 112.313(7)(a), Florida Statues. An effective waiver requires a two-thirds vote of the County Commission after full disclosure of the conflicting relationship (Motion B). Forms 4A attached hereto as Exhibit 1 constitute full disclosure of any existing conflict.

Fiscal Impact/Cost Summary:
The Second Amendment is for an amount of $779,378 which increases the total funding for this Agreement from $5,751,090 to $6,530,468. Funds are requested in the second supplemental budget on the current agenda and will be disbursed upon approval.
