MOTION TO AWARD fixed contract to single bidder, The BG Group, LLC for Demolition Services for Portside Center and Port Everglades Terminal 1, Quotation No. PNC2116668C1, from Qualified Vendor List No. PNC2116266Q1, in a not-to-exceed amount of $1,500,000, which includes allowances in the amount of $20,000, to be substantially completed within 120 calendar days from the Project Initiation Date listed in the Second Notice to Proceed, contingent upon the receipt and approval of insurance/performance and payment guaranty, and authorize the County Administrator to execute same.

(Per the Tuesday Morning Memorandum, Board consideration of this item is based upon the contract executed by the proposed vendor, which contained changes from the draft contract (Exhibit 2) which was distributed as Additional Material to this item. The Board's consideration of Item 36 is also based upon the revised Motion Statement, which was also distributed as Additional Material to this item.)

Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.31.a.4, Board approval is required for awards exceeding $500,000 that includes a single bidder, rejection of apparent low bidder, or protested award.
What Action Accomplishes
Provides for the demolition of the Portside Center and Port Everglades Terminal One, which is necessary for the development of the Convention Center Expansion and Headquarters Hotel Project.

Summary Explanation/Background
This agenda supports the Board's goal of increased economic strength and impact of revenue-generating County enterprises balancing economic, environmental, and community needs.

On October 3, 2017, the Direct Procurement Authority (DPA) approved 1) a new design for the headquarters hotel, 2) a new design agreement between Matthews Southwest (MSW) and Broward, and 3) entering into exclusive negotiations with Omni Hotels and Resorts as the preferred hotel operator (flag) for the Convention Center Headquarters Hotel.

On February 27, 2018, the DPA heard presentations from County staff and from the MSW development team on the anticipated project costs and financing alternatives for the two major components of the projects. The DPA expressed support for the County financing the hotel project.

On August 14, 2018, the DPA heard presentations from County staff and from the MSW development team on the updated design proposal for the Project that provided for an expansion of contiguous exhibition space. The DPA expressed support for the new design. The DPA also approved an amendment to the current design contract with MSW that will allow the design work for the hotel to proceed in tandem with the design work for the convention center.

On January 8, 2019, the DPA approved a Technical Services Agreement with Omni Hotels and Resorts.

On February 15, 2019, the Purchasing Division posted a limited solicitation for the procurement of demolition services for the Portside Center and Port Everglades Terminal One and invited all nine pre-qualified vendors to participate (Qualified Vendors List (QVL), PNC2116266Q1 for Demolition Services). Staff held a pre-bid conference at the demolition site on February 25, 2019 to better familiarize the vendors with the job. Five vendors attended the meeting.

The demolition of the Portside Center and Port Everglades Terminal One is necessary for the development of the Convention Center Expansion and Headquarters Hotel Project. The demolition of the Portside Center provides space for the new headquarters hotel and the demolition of Terminal One provides space for the Eastern expansion of the convention center.

Staff reviewed bid submittal and determined that optional item no. 09 (Terminal One asphalt) was not required and will not be awarded. Based on removal of line item, The BG Group, LLC is reviewing pricing for remaining items and staff will confirm fair and reasonable pricing.

The bid posted on February 15, 2019 and opened on April 20, 2019; only one bid was received.

Fiscal Impact/Cost Summary:
The not-to-exceed cost of $1.5 million for the demolition for the Portside Center and Port Everglades Terminal 1 is included in the Fiscal Year 2019 Budget.
