Requested Action
MOTION TO AWARD open-end contract to low responsive, responsible bidder, Prestige Property Maintenance Inc., for Maintenance of Greenways and Miscellaneous Landscaping, Bid No. BLD2115965B2, for the Highway and Bridge Maintenance Division, in the annual estimated amount of $1,945,358, which includes allowances in the total amount of $104,000; and authorize the Director of Purchasing to renew the contract for two one-year periods, for a three-year potential estimated amount of $5,836,073. The initial contract period shall begin on May 1, 2019 and will terminate one year from that date.

ACTION:  (T-11:36 AM)  Approved.

Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.31.a.4, Award Authority, Board approval is required for awards exceeding $500,000 that include a single bidder, rejection of apparent low bidder, or protested award.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE HIGHWAY AND BRIDGE MAINTENANCE DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

The Office of Economic and Small Business Development (OESBD) established a County Business Enterprise (CBE) goal of 25% for this contract. Prestige Property Maintenance Inc. (Prestige) committed to 29.61% CBE participation, which has been reviewed and approved by the OESBD (Exhibit 2).

The purpose of this contract is to provide all labor, materials, equipment and incidentals necessary for maintenance services of greenways and miscellaneous landscaping at various Broward County locations for the Highway and Bridge Maintenance Division.

The allowances incorporated in this contract, in the total amount of $104,000, include: $90,000 for miscellaneous specialized services; $10,000 for miscellaneous parts and materials; and $4,000 for permit fees. Expenditures under these allowance items must be approved by the contract administrator and will be reimbursed at the contractor's actual incurred cost, without mark-up.

Bid No. BLD2115965B2 was advertised with four distinguished groups. Prestige is the recommended bidder for all four groups.

The Director of Purchasing determined the apparent low bidder for Group 3, All City Turf, LLC, to be non-responsive based upon the findings of the OESBD that the bidder was non-compliant with the CBE requirements of the solicitation. MCT Service, LLC was also determined to be non-responsive based upon the findings of the OESBD that the bidder was non-compliant with the CBE requirements of the solicitation (Exhibit 2).

The Director of Purchasing determined the apparent low bidder for Group 4, Royal Regions Incorporation, to be non-responsive in meeting the license requirements of the solicitation. All City Turf, LLC and MCT Service, LLC were also determined to be non-responsive in meeting the license requirements of the solicitation.  In the Special Instructions to the vendors' section of the solicitation, it required the vendor to possess, at the time of solicitation submittal, a Tree Trimming License, which Royal Regions, All City Turf, LLC and MCT Services, LLC did not possess.  

In accordance with the Broward County Living Wage Ordinance, Section 26-101 (i), these services are subject to the Living Wage. Prestige has agreed to be bound to the contractual obligations of the Living Wage Ordinance. Additionally, the amendment to effectuate the changes to the new Living Wage requirements will be executed contingent upon Board Approval of the contract.

In accordance with the Broward County Workforce Investment Program, Broward County Administrative Code, Section 19.211, these services are subject to the Workforce Investment Program. Prestige has agreed to be bound to the contractual obligations of the Workforce Investment Program, as amended. 

The Highway and Bridge Maintenance Division has reviewed the bid submitted by Prestige and concurs with the recommendation for award (Exhibit 3). Ten vendor performance evaluations have been completed for Prestige; the firm has an overall rating of 3.88 out of a possible 5. Copies of Prestige vendor performance evaluations are available upon request.

Incumbent: Prestige Contract No. G1298502B1, Maintenance of Greenways and Miscellaneous Landscaping; Contract Term: June 15, 2015 through June 14, 2018 with a 90-day extension through September 14, 2018. Expenditures to date: $2,789,791. The Director of Purchasing approved Interim Contract No. G1298502BX through March 14, 2019. Expenditures to date: $398,495.

The amounts referenced in this agenda were rounded to the nearest whole dollar. Vendor payments will be based on the actual total bid amount. The bid tabulation reflects the actual amount of the award.

There was no protest or appeal filed regarding this procurement.

The bid posted on July 30, 2018 and opened on August 13, 2018; four bids were received with no declinations (Exhibit 1).  Bid validity extension from Prestige was secured through May 10, 2019.  The reasons for the delay in the recommendation for award is due to the implementation of the requirements for the amended Living Wage Ordinance.
