Requested Action
MOTION TO AUTHORIZE Agreement with Florida Power Light (FPL) for the placement of solar panels on the BB&T Center arena and/or the BB&T Center property at no cost to the County; subject to an early termination fee, to include acquisition of real property between the Sawgrass Expressway and Canal L-35A from property owned by FPL at a price not to exceed fair market value to allow for the construction of a pedestrian/bicycle bridge pathway running along and into the Everglades. (Please note that the agreement is not attached and will be submitted under separate cover).

ACTION:  (T-2:53 PM)  Following discussion, and without objection, the Board moved the Agenda.  (Refer to minutes for full discussion.)  (See Yellow-Sheeted Additional Material 75, dated May 7, 2019, submitted at the request of the Office of the County Attorney, and Yellow-Sheeted Additional Material 75(2) submitted at the request of County Administration.)
Why Action is Necessary
As the owner of the BB&T Center, the County would have to agree to the potential repayment of any unamortized value of the solar panel installation in the event it is removed and allows the county to enter into negotiations for the acquisition of FPL owned property.
What Action Accomplishes
Allows the County to acquire property that may be used to support amenities contemplated for the redevelopment of the BB&T Center site.

Summary Explanation/Background
On April 16, 2019 (Item No.48), the Board authorized staff to continue negotiations with representatives from FPL for the solar panel installation while working to acquire property to assist with amenities associated with the BB&T Redevelopment Project. County staff and FPL will be meeting on Friday, April 26, 2019 to determine if a final agreement can be reached. If such agreement is reached, it will be distributed under separate cover.
