A. MOTION TO CONSIDER enactment of an Ordinance, the title of which is as follows:

AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO PARKS AND RECREATION; AMENDING CHAPTER 23, ARTICLE II OF THE BROWARD COUNTY CODE OF ORDINANCES ("CODE"); CREATING DIVISION 4, RELATING TO PAY PARKING AT BROWARD COUNTY PARKS; PROVIDING FOR PAY PARKING ZONES AND FEES; PROVIDING FOR PARKING PAY STATIONS, INCLUDING, BUT NOT LIMITED TO, PAY-BY-PHONE APPLICATIONS AND/OR LICENSE PLATE RECOGNITION TECHNOLOGY; ESTABLISHING PARKING  REGULATIONS AND PROVIDING FOR ENFORCEMENT OF PARKING VIOLATIONS; ESTABLISHING PROCEDURES FOR ISSUANCE OF PARKING CITATIONS; ESTABLISHING CIVIL PENALTIES FOR PAY PARKING VIOLATIONS AT COUNTY PARKS; AND PROVIDING FOR APPEALS, SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

B. MOTION TO CONSIDER adoption of a Resolution No. 2019-263 Amending the Broward County Administrative Code, the title of which is as follows:

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO PARKING FEES AND CONCESSION REVENUES IN SELECT BROWARD COUNTY PARKS; AMENDING SECTION 37.33 OF THE BROWARD COUNTY ADMINISTRATIVE CODE ("ADMINISTRATIVE CODE"); AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE ADMINISTRATIVE CODE, AND AN EFFECTIVE DATE.

ACTION:  (T-12:00 PM)  Approved as amended with Yellow-Sheeted Additional Material, 13(b) dated April 9, 2019, submitted at the request of the Office of the County Attorney.  (Refer to minutes for full discussion.)

Why Action is Necessary
A. A Resolution directing the County Administrator to publish notice of public hearing to consider enactment of the Ordinance was adopted by the Board of County Commissioners at its meeting of April 9, 2019.

B. A Resolution directing the County Administrator to publish notice of public hearing to consider adoption of the Resolution Amending the Broward County Administrative Code was adopted by the Board of County Commissioners at its meeting of April 9, 2019.
What Action Accomplishes
A. Provides for amendments to the Code of Ordinances relating to the payment for parking in County parks to create new provisions to allow the County to charge for parking at County parks, establishes the method of enforcement of paid parking by citation and civil penalties, and establishes a hearing procedure for contesting citations.

B. Provides for amendments to the Broward County Administrative Code relating to pay parking at County parks, which amendments are required to ensure consistency with the proposed Ordinance.

Summary Explanation/Background
There is currently no provision in the County Code that addresses payment for parking in County parks and issues related to enforcement of parking violations. The proposed Ordinance would create new Code provisions to allow the County to charge for parking at County parks, establish the method of enforcement of paid parking, and establish a hearing procedure for contesting citations.

The proposed Administrative Code Resolution establishes (i) a parking fee schedule applicable in those areas with parking pay stations, and (ii) that the parking fees collected in parking pay stations located in Hollywood North Beach Park, parking fines, and revenue from concessions at Hollywood North Beach Park be segregated and deposited into a fund to be used solely for the purposes of administering and enforcing the pay parking zones in Hollywood North Beach Park and funding operational and capital improvements in Hollywood North Beach Park.

At the Commission meeting on April 9, 2019, the Board approved an amendment to the proposed Administrative Code Resolution to clarify that the reference to "Pay Parking Zone," and the parking fees required for parking in a Pay Parking Zone, relates only to parking at Hollywood North Beach Park. That amendment has been incorporated into the attached proposed Administrative Code Resolution. Additionally, a minor change was made to the title of that Resolution to ensure that the title sufficiently describes the content of the proposed Resolution.
