THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE ENVIRONMENTAL AND CONSUMER PROTECTION DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.
Approval of this item authorizes execution of Amendment No. 2 to Contract No. GC920 between the FDEP and Broward County, providing for continued funding and oversight of State-regulated storage tank facility inspection activities within Broward County on behalf of the State. Work under the contract is assigned via annual task assignments, scope of work, and associated guidance documents.
On June 6, 2017, the Board approved Contract No. GC920 between Broward County and the FDEP (Item No. 22), to provide for the performance of inspection activities at State-regulated storage tank facilities within Broward County, effective July 1, 2017, through June 30, 2027. On August 14, 2018, the Board further approved Amended and Restated Contract (ARC) No. GC920 (Item No. 27) to facilitate updating the guidance documents and maintaining its effective dates. The FDEP has now provided Amendment No. 2 to Contract No. GC920 to clarify that FDEP payments to the County are on a combination fee-schedule/cost-reimbursement basis not to exceed $4,309,477 (as previously approved by the Board), which includes the cost reimbursement not to exceed $40,000 for incidental training and travel costs particular to FDEP training in new technology and program management changes, that Broward County will not inspect its own facilities under this Contract, and that FDEP may update or amend guidance documents, as needed. Amendment No. 2 has been reviewed and approved as to Insurance Requirements by the Risk Management Division and as to form by the Office of the County Attorney (Exhibits 1 and 2).
Because the County is the recipient of funds from a state agency under this Contract, the County’s standard form agreement provisions are not included. The Contract and this Amendment No. 2 include that FDEP may update or amend the Scope of Work, issue Task Assignments, and update or amend guidance documents during the Contract term without a formal amendment, all of which may update and/or establish guidelines, processes and procedures as applicable to Broward County and the FDEP.
