THE PURCHASING DIVISION AND THE AVIATION DEPARTMENT RECOMMEND THE APPROVAL OF THE ABOVE MOTION.
The Office of Economic and Small Business Development (OESBD) designated this project as a reserved project for County Business Enterprise (CBE) firms (Exhibit 2).
Pursuant to Section 1-81.3.e of the County Business Opportunity Act of 2012, as amended when a CBE reserve is established, CBEs and non-CBEs may respond to the solicitation. If no CBE firm is available to perform the reserve work, a non-CBE firm may be awarded the contract. DBF Construction LLC committed to a 16.48%, which has been reviewed and approved by OESBD (Exhibit 2).
In accordance with the Broward County Workforce Investment Program, Broward County Administrative Code, Section 19.211, these services are subject to the Workforce Investment Program. DBF Construction LLC has agreed to be bound to the contractual obligations of the Workforce Investment Program.
The purpose of this contract is to provide for the furnishing of all labor, material, equipment, services and incidentals, which consists of the construction, furnishing and installation of the approximately 6,000 linear feet of 8-inch and 4-inch irrigation transmission system for the Green Belt Park Irrigation Main Extension project The Irrigation Main installation will include crossing under the FEC and FDOT right-of-way with two directional drill operations and two jack and bore operations. In addition to the irrigation main being installed, there will be upgrades made to the existing irrigation pump located at the northeast pond and the installation of a new booster pump at the south green belt buffer, prior to connection to the existing system at Broward County's Fort Lauderdale-Hollywood International Airport (Aviation).
This procurement carries a 100% performance and payment guaranty. The Purchasing Division confirmed with the surety company that DBF Construction LLC has the capacity to obtain the required guaranty.
The allowance incorporated into this contract in the amount of $19,000 is for permitting fees and regulatory agency fees. Expenditures under this allowance item must be approved by the contract administrator and will be reimbursed at the contractor’s actual cost without mark-up (Exhibit 4).
The Director of Purchasing has determined that the low bidder, SkyData UAV, to be non-responsive; the bidder did not submit a bid bond as required by the solicitation document and the vendor only responded to one line item out of 78 line items.
The Director of Purchasing has determined that the certified CBE firm, Southern Underground Industries, Inc., to be non-responsive to the bid requirements; the bidder did not meet the CBE requirements as stated in the bid documents. The vendor could not meet the requirements to perform 100% of the work with its own work forces or subcontract portions of the work to other CBE firms.
The Aviation Department has reviewed the bid submitted by DBF Construction LLC and concurs with the recommendation for award (Exhibit 3). No performance evaluations have been completed for DBF Construction LLC. The Vendor Reference forms are included as part of Exhibit 3, pages 2 through 4.
The Purchasing Division has researched the prices submitted by the recommended bidder, DBF Construction LLC, and has been determined that the prices submitted are fair and reasonable in comparison to the price analysis (Exhibit 4).
The amount referenced in this agenda item have been rounded to the nearest whole dollar. Vendor payments will be based on the actual total bid amount. The bid tabulation reflects the actual amount of the award.
The bid validity for this project expired on February 9, 2019. DBF Construction LLC has agreed to extend its bid validity through May 10, 2019 for Bid No. PNC2116455C1.
There were no protest or appeals regarding this procurement.
The bid posted on August 24, 2018 and opened on October 12, 2018; two bids were received with one partial bid received (Exhibit 1).
