B. MOTION TO AUTHORIZE Director of Purchasing to negotiate and execute a software support and maintenance agreement between Broward County and Bruel & Kjaer EMS Inc., subject to approval from the County Attorney's Office as to legal sufficiency, to provide system administration and support, software management services and upgrades, and system maintenance and information management for the Airport Noise and Operations Monitoring System for up to five years, consistent with the estimated amount referenced in the fiscal impact.

Why Action is Necessary

Motion A: Board approval is required for sole source procurement above the award authority of the Director of Purchasing in accordance with Broward County Procurement Code, Section 21.34.

Motion B: Board approval is required for all contracts for supplies and services of more than five years in accordance with Broward County Procurement Code, Section 21.43, and to authorize the Director of Purchasing to execute agreements in accordance with Broward County Procurement Code, Section 21.14.c.6.

What Action Accomplishes
Motions A and B: Allow for the continuation of maintenance and services relating to the Aviation Department's Airport Noise and Operations Monitoring System.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE AVIATION DEPARTMENT RECOMMEND THE APPROVAL OF THE ABOVE MOTIONS.

The Aviation Department (Airport) owns and maintains noise monitoring equipment which includes the Airport Noise and Operations Monitoring System (ANOMS) software, eleven permanent noise monitor terminals located in various locations throughout the surrounding communities around the airport, and a subscription for flight tracking data feed from a Passive Secondary Surveillance Radar. The system as a whole allows the Airport to provide specialized noise data and reports to the surrounding communities and Aviation Industry. Services include system administration, hardware, maintenance, software system management and information management services. The ANOMS software is a trademarked product that is exclusively provided and serviced by Bruel & Kjaer EMS Inc. The ANOMS was first acquired by the County in 1992 from Technology Integration, Inc. through a Request for Proposals procurement. On March 7, 2000, Lochard Corporation obtained the sole source propriety maintenance rights from Technology Integration, Inc.

On November 22, 2006, the Director of Purchasing approved a sole source designation for Lochard Corporation for the ANOMS support and maintenance.

On July 16, 2007, the Director of Purchasing executed an agreement between Broward County and Lochard Corporation for the ANOMS.

On February 9, 2009, Bruel & Kjaer EMS Inc. acquired Lochard Corporation.

On December 6, 2010, the Director of Purchasing executed an agreement between Broward County and Bruel & Kjaer EMS Inc. for ANOMS which included hardware, software, support and maintenance services for the Aviation Department.

On April 18, 2014, the Director of Purchasing recommended the approval of the sole source/brand designation request for the ANOMS.

On June 3, 2014 (Item No. 31), the Board approved a sole source designation for Bruel & Kjaer EMS Inc. and a software license, maintenance and support agreement for ANOMS.

On March 28, 2019, the Director of Purchasing recommended the approval of the sole source/brand designation request for ANOMS (Exhibit 1).
