MOTION TO RETROACTIVELY APPROVE additional threshold increase for Contract No. BLD2116202B1, Water and Mold Remediation Services, with United Restoration of FL, LLC, for the Facilities Management Division and various Broward County agencies, in the increased amount of $500,000 for an estimated not-to-exceed threshold amount of $986,975 for the remainder of the contract's current term, which is through August 20, 2019.

Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.31.a.4, Award Authority, Board approval is required for awards exceeding $500,000. The increase to the contract threshold exceeds the authority of the Director of Purchasing.
What Action Accomplishes
Provides additional funding threshold for uninterrupted, continued water and mold remediation services at various Broward County operated facilities and locations for the remaining term of the contract.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/FACILITIES MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

The Office of Economic and Small Business Development (OESBD) designated this project reserved for the Small Business Enterprises (SBE). United Restoration of FL, LLC is a certified SBE firm.

The purpose of this contract is to provide water and mold remediation services to County-owned facilities when such conditions present themselves on an emergency basis. The work being performed under this contract consists of labor and equipment rental for water extraction, mold remediation, carpet and ceiling removal and/or cleaning.

On August 21, 2018, Contract No. BLD2116202B1, Water and Mold Remediation Services, was awarded by the Director of Purchasing to certified SBE, United Restoration of FL, LLC, in the estimated not-to-exceed amount of $180,686 for a fixed one-year term with no renewals. The contract began on August 21, 2018 and will expire on August 20, 2019.

As of March 13, 2019, the current expenditures on Contract No. BLD2116202B1 were $181,062. On March 22, 2019, the Director of Purchasing approved a threshold increase in the amount of $306,289.81, increasing the estimated not-to-exceed threshold amount to $486,975.91 to provide for sufficient threshold to pay past due invoices for work previously performed and to allow for continuity of services for the Facilities Management Division and various other Broward County agencies.

On March 28, 2019, the Facilities Management Division requested another contract threshold increase in the amount of $486,443. Contract No. BLD2116202B1 is utilized countywide, and there are additional agencies that have needs for these services. Therefore, the additional threshold increase should be sufficient to cover any additional services necessary. Specifically, the threshold increase will cover: purchase orders in the amount of $39,359.51; identified countywide projects in the amount of $75,552.74; the estimated usage in the amount of $347,825.55; and the inclusion of additional funds for unforeseen countywide needs for the remainder of the contract term from March 28, 2019 to August 20, 2019 (Exhibit 1).

In accordance with the Purchasing Division's Master Agreement Threshold Policy, if the initial award was made within the Director of Purchasing's award authority, but the actual expenditures exceeded the Director of Purchasing's authority, and there was not an anomaly with market conditions, the contract is to be re-bid. It is anticipated that a replacement contract will be completed and awarded prior to expiration of current Contract No. BLD2116202B1.
