Requested Action
MOTION TO AWARD open-end contract to low responsive, responsible bidder, American Drug Screen Corporation, for Urine Drug Tests and Supplies, Bid No. GEN2117240B1, for the Broward Addiction and Recovery Centers, in the annual estimated amount of $174,210, and authorize the Director of Purchasing to renew the contract for two one-year periods, for a three-year potential estimated amount of $522,630. The initial contract period shall begin on the date of award and will terminate one year from that date.

Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.31.a.4, Award Authority, Board approval is required for awards exceeding $500,000 that includes a single bidder, rejection of apparent low bidder, or protested award.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE HUMAN SERVICES DEPARTMENT/BROWARD ADDICTION AND RECOVERY DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

The Office of Economic and Small Business Development did not assign Small Business Enterprise (SBE) or County Business Enterprise (CBE) goals for this project because there were no subcontracting opportunities for SBE or CBE contractors (Exhibit 2).

The purpose of this contract is to provide Urine Drug Tests and Supplies for the Broward Addiction and Recovery Centers (BARC).

The Director of Purchasing has determined the apparent low bidder, American Screening Corporation, to be non-responsive to the bid requirements. The bidder submitted multiple urine tests, which took too long to render. Once samples were rendered, the lines were very thin and hard to read. The oral test did not always render a result.

BARC has reviewed the bid submitted by American Drug Screen Corporation, and concurs with the Recommendation for Award (Exhibit 3). No vendor performance evaluations have been completed for American Drug Screen Corporation.

On November 21, 2018, the President of Pharmacare International, Inc. filed a timely protest on behalf of Pharmacare International, Inc and on January 11, 2019 the Director of Purchasing issued a response to the protest. (Exhibit 5).

On February 13, 2019, the Director of Purchasing issued a second response reaffirming the denial of the protest (Exhibit 6).

The amounts referenced in this agenda were rounded to the nearest whole dollar. Vendor payments will be based on the actual total bid amount. The bid tabulation reflects the actual amount of the award.

The initial bid submitted by American Drug Screen Corporation was $248,017; the vendor offered a voluntary price reduction and overall cost savings of $73,807 to the County, and a revised total estimated annual amount of $174,210. The Broward County Procurement Code, Section 21.30.f.2(c), allows for acceptance of a voluntary reduction after bid opening, if such reduction does not result in the modification or deletion of any condition of the bid.

Incumbent: Pharmacare International, Inc., Contract Number and Title: G2113205B1, Drug Test and Urine Cups, Contract Term: March 6, 2017 through March 5, 2018. Expenditures to date: $84,349.

The bid posted on July 16, 2018 and opened on July 30, 2018; 11 bids were received with no declinations (Exhibit 1).
