Summary Explanation/Background
PUBLIC WORKS DEPARTMENT/HIGHWAY CONSTRUCTION AND ENGINEERING DIVISION RECOMMENDS APPROVAL.

Broward County is planning to install fiber optic cables along Pine Island Road from the Broward County Emergency Operations Center to Oakland Park Boulevard in the Cities of Plantation and Sunrise. This construction project will require crossing the Old Plantation Water Control District's Canal No. 2L-2W, Canal No. 2L-3W and Canal No. C2 along the east side of Pine Island Road. The District is agreeable to these canal crossings and requires the use of a permit, rather than a typical revocable license agreement, to provide Broward County with the necessary access.

Approval of the permit by the Board of County Commissioners will allow Broward County to construct, maintain and repair improvements within the District's canals. The permit is a non-exclusive, revocable permit. It includes limitation statements, insurance requirements, and an indemnification provision which are typically included in a revocable license agreement rather than in a permit. The District requires these permit conditions for projects within its canals.

The permit has been reviewed and approved as to form by the County Attorney's Office and the Risk Management Division.
