Why Action is Necessary
Land Use Plan Amendment PC 15-6, Condition 1 contains a voluntary commitment by the owners of property to record a Declaration of Restrictive Covenants.

Implements voluntary commitments and ensures compliance with Land Use Plan Amendment PC 15-6 and the Broward County Land Use Plan.

Summary Explanation/Background
THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE PLANNING AND DEVELOPMENT MANAGEMENT DIVISION RECOMMEND APPROVAL.

Broward County Land Use Plan Amendment (LUPA) PC 15-6 affects 64.4-acres located on the southwest corner of Loxahatchee Road and Bishop Pit Road (Exhibit 1). There are two property owners: TLH SABRA2, LLC owns the 44.6-acre “Tuttle Property;”  and Sabra Land Trust owns the 19.8-acre “Katz Property.” On April 28, 2015, the Board adopted PC 15-6 to change the land use designation from Palm Beach County Rural Residential - 10 (one dwelling unit per ten acres) to Low (3) Residential. The developer made voluntary commitments to restrict the development to 186 single family dwelling units for persons aged 55+ years, and to contribute $1 per gross square foot of the dwelling units to Broward County for affordable housing. This Declaration of Restrictive Covenants (Exhibits 2 and 3), submitted by TLH SABRA2, LLC, is for the voluntary commitments which apply only to the Tuttle Property (129 dwelling units). The Katz Property (57 dwelling units) is not included in this Declaration of Restrictive Covenants and the LUPA will not be certified for the Katz Property at this time.

Planning Council staff have provided comments in the attached memorandum which indicate no objection to this request (Exhibit 4).

This agreement has been approved as to form by The Office of the County Attorney.
