Board approval is required to vacate utility easements pursuant to Broward County Administrative Code, Chapter 25.

Summary Explanation/Background
THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE PLANNING AND DEVELOPMENT MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

The Planning and Development Management Division has received a request to vacate a ten-foot wide utility easement, a ten-foot wide landscape buffer easement, and a 30-foot wide drainage easement, all lying within Tract A of the Millcreek Ranches Plat, as recorded in Plat Book 174, Page 110, of the Public Records of Broward County, located west of Southwest 148 Avenue and north of Southwest 31 Court in the Town of Davie. Vacating this right-of-way easement will provide clear and unencumbered title to the property owners.

A companion item to vacate a 25-foot right-of-way easement is also scheduled for the Board consideration on April 9, 2019.

The Town of Davie approved this vacation by adopting Resolution No. R-2017-163 on May 3, 2017. Review of this application by the applicable County agencies and utility companies indicates that the utility easements are currently unused, and there are no plans for future use. No objections to this vacation were raised by any of the reviewing agencies.

This vacation application has been reviewed and approved as to form by the Office of the County Attorney.
