A. MOTION TO RELEASE condition imposed on May 22, 2018, Agenda Item 44.A., related to Broward County Small Scale Land Use Plan amendment PC 18-5, within the City of Pompano Beach ("City"), that City enter into an Evacuation Sheltering Agreement with Broward County prior to the effectiveness of Ordinance No. 2018-24, which adopted the Small Scale Land Use Plan amendment. (Commission District 4)

ACTION:  (T-10:47 AM)  Approved.  (Refer to minutes for full discussion.)

VOTE:  8-0.  Commissioner Geller voted in the affirmative telephonically.  Vice-Mayor Holness was not present during the vote.

ACTION:  (T-11:23 AM)  Vice-Mayor Holness requested being shown voting in the affirmative on all items that passed.

VOTE:  9-0.


B. MOTION TO RELEASE condition imposed on May 22, 2018, Agenda Item 44.B., related to Broward County Land Use Plan text amendment PCT 18-3 within the City, that City enter into an Evacuation Sheltering Agreement with Broward County prior to the effectiveness of Ordinance No. 2018-25, which adopted the Small Scale Land Use Plan text amendment. (Commission District 4)

Approval of the Broward County Board of County Commissioners ("Board") is necessary to release these conditions of approval.

The action releases conditions imposed on May 22, 2018, that the City enter into an Evacuation Sheltering Agreement with Broward County.

Summary Explanation/Background
On May 22, 2018, the Board considered Broward County Small Scale Land Use Plan amendment PC 18-5 and corresponding Land Use Plan text amendment PCT 18-3, regarding the Pompano Beach Hidden Harbour Activity Center. Based on the Planning Council's recommendations, the Board conditioned the effectiveness of Ordinance No. 2018-24 (Exhibit 1) and Ordinance No. 2018-25 (Exhibit 2) approving the amendments (collectively, the "Ordinances") on several requirements, including that the City enter into an Evacuation Sheltering Agreement with Broward County, in substantially the form presented to the Board at the public hearing. The City did not execute the Evacuation Sheltering Agreement.  
 
On March 28, 2019, Agenda Item 51, the Board discussed Broward County's policy regarding city staff being used as shelter volunteers. During that discussion, the Board directed the County Attorney to prepare an agenda item that would remove the requirement that the City execute an Evacuation Sheltering Agreement prior to the effectiveness of the Ordinances. This item accomplishes that purpose.
