MOTION TO ADOPT Resolution No. 2019-138 directing the County Administrator to publish Notice of Public Hearing to be held on Tuesday, April 16, 2019, at 10:00 a.m., in Room 422 of the Governmental Center to consider adoption of a proposed Resolution Amending the Broward County Administrative Code, the title of which is as follows:
 
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO MEMBERSHIP REQUIREMENTS OF THE SMALL BUSINESS DEVELOPMENT ADVISORY BOARD; AMENDING SECTION 12.225 OF THE BROWARD COUNTY ADMINISTRATIVE CODE ("ADMINISTRATIVE CODE"); AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE ADMINISTRATIVE CODE, AND AN EFFECTIVE DATE.

Summary Explanation/Background
In 2016, the Board of County Commissioners ("Board"), through the Intergovernmental Affairs/Boards Section ("IABS"), commenced its review of all existing Broward County boards, authorities, and agencies subject to the Sunset Ordinance, Section 1-244, et seq., of the Broward County Code of Ordinances (the "Sunset Review").  During 2018, the Board enacted various Sunset Review recommendations, including amendments to the membership categories of the Small Business Development Advisory Board ("SBDAB"). After realizing that the current SBDAB membership categories limit Commissioners' ability to appoint otherwise qualified persons to the SBDAB, IABS withdrew further SBDAB recommendations from the Sunset Review process to confer with County staff, the Office of Economic and Small Business Development, the County Attorney's Office, and SBDAB to determine the best approach to revising the SBDAB appointment process. IABS determined that making SBDAB membership categories discretionary would allow Commissioners the most flexibility in SBDAB appointments. Based on this IABS determination, the Office of the County Attorney has revised the applicable section of the Administrative Code to allow SBDAB board appointments based upon consideration given to certain organizations but without required categories.
