MOTION TO AUTHORIZE County Administrator to negotiate and execute Broward County Local Government Radio System Utilization Agreements with the municipal and special district users of the County’s local government radio system in substantially the form as Exhibit 1 with only nonsubstantive changes, in consultation with and subject to review as to legal sufficiency by the County Attorney’s Office.

Why Action is Necessary
In accordance with Section 21.31.a.4 Broward County Procurement Code, all awards greater than the award authority of the Director of Purchasing require Board approval.
What Action Accomplishes
Authorizes the County Administrator to negotiate and amend the existing Radio One Agreement, and negotiate and execute Broward County Local Government Radio System Utilization Agreements to permit additional local government entities to utilize the County’s local (non-public safety) digital radio system on a timely basis.

Summary Explanation/Background
THE OFFICE OF REGIONAL COMMUNICATIONS AND TECHNOLOGY RECOMMENDS APPROVAL OF THE ABOVE MOTION.

This item would authorize the County Administrator to negotiate and execute Broward County Local Government Radio System Utilization Agreements with the School Board of Broward Board (“SBBC”) and other local government entities that desire to utilize the County’s local government radio system for non-public safety users, provided that Board approval would be required for any Utilization Agreement that incurs additional costs to County that exceed the not-to-exceed amounts authorized in the contract with local government radio system vendor, Radio One, Inc. (including as may be amended from time to time). These Utilization Agreements are anticipated to be for a five year term with unlimited renewals upon approval.

The design of the Local Government Radio System was intended for County non-public safety operations to be relocated off the public safety radio system. As part of this effort, other local government entities and the School Board were offered an opportunity to join the County's system with the understanding that they would be responsible for incremental costs to expand and maintain the system to accommodate for their users. 

These Utilization Agreements are anticipated to be for a five year term with unlimited renewals upon approval. The Utilization Agreements would establish the technical requirements and protocols to ensure the integrity of the system, as well as allocate responsibilities for the incremental costs. The estimated project costs for the inclusion of each new entity would be identified in advance.
