MOTION TO ADOPT Resolution No. 2019-093 directing the County Administrator to publish Notice of Public Hearing to be held on Tuesday, April 9, 2019, at 10:00 a.m. in Room 422 of the Governmental Center, 115 South Andrews Avenue, Fort Lauderdale, Florida to vacate a 12-foot wide utility easement lying within Parcels A and B of the Hasey Center Plat, as recorded in Plat Book 136, Page 39, of the Public Records of Broward County, located at 1800 West Sample Road in the City of Pompano Beach; Petitioner: Costco Wholesale Corporation; Agent: Ryan O. Thomas, Thomas Engineering; Application for Vacation and Abandonment: 2018-V-12. (Commission District 4)

ACTION:  (T-10:33 AM)  Approved.

VOTE:  8-0.  Commissioner Geller was not present.
Why Action is Necessary
Board approval is required to vacate platted easements pursuant to Broward County Administrative Code, Chapter 25.
What Action Accomplishes
Directs the County Administrator to publish a Notice of Public Hearing for the abandonment of easements in accordance with Broward County Administrative Code, Chapter 25.

Summary Explanation/Background
THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE PLANNING AND DEVELOPMENT MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

The Planning and Development Management Division has received a request to vacate a 12-foot wide utility easement lying within Parcels A and B of the Hasey Center Plat, as recorded in Plat Book 136, Page 39, of the Public Records of Broward County, located at 1800 West Sample Road in the City of Pompano Beach. Vacating this right-of-way easement will provide clear and unencumbered title to the property owners.

The City of Pompano Beach approved this vacation by adopting Ordinance No. 2018-35 on February 13, 2018. Review of this application by the applicable County agencies and utility companies indicates that the utility easement is currently unused, and there are no plans for future use. No objections to this vacation were raised by any of the reviewing agencies.

This vacation application has been reviewed and approved as to form by the Office of the County Attorney.
